VACANCIES, TRANSFERS AND PROMOTIONS. 10.1 All vacancies shall be emailed to all ESP members and will remain open for a minimum of seven (7) workdays. Said vacancy shall contain the following information: 1. Application deadline. 2. Copy of position profile. Qualified ESP members who apply shall be interviewed along with applicants from outside the ESP. A good faith effort will be made by the College to fill a vacant position in as timely a manner as possible. 10.2 Interested ESP members may apply in writing to the Human Resources Office within the vacancy period. The college may consider seniority within the unit if the qualifications of two (2) employees are equal. 10.3 In the event of promotion in or transfer from one classification to another, the ESP member shall be given a thirty (30) workday trial in which to show his/her ability to perform on the new job. The College shall give the promoted or transferred ESP member reasonable assistance to enable him/her to perform up to the College's standards on the new job. If the ESP member is unable to perform the work required during the trial period or at the option of the affected ESP member, the ESP member shall be returned to his/her previous assignment. 10.4 If an employee is transferred to a position outside the ESP and, thereafter, within six (6) months is transferred back to a position within the ESP, seniority shall accumulate while working in the position to which he/she was transferred. Employees transferred under the above circumstances shall retain all rights accrued for the purpose of any benefits provided for in this Agreement. 10.5 ESP members shall not be placed on a lower column of the compensation model due to involuntary transfers. 10.6 The parties agree that involuntary transfers of ESP members are to be effected only for reasonable and just cause. 10.7 The College may temporarily fill, for a period not to exceed ninety (90) working days, new job classifications and vacancies, in any manner, which it may deem necessary, until such openings are filled, pursuant to the provisions of this Article. This time frame may, due to extenuating circumstances, be extended upon mutual agreement of the parties. 10.8 Any ESP member, who temporarily assumes the duties of another ESP member for fifteen (15) or more consecutive working days, will be paid the regular rate of pay for those duties retroactive to the first date of assuming those duties. An ESP member's pay rate shall not be reduced as the result of any temporary change in duties. 10.9 The need for temporary ESP positions shall be communicated, in writing, to the ESP Team Leader.

VACANCIES, TRANSFERS AND PROMOTIONS. 10.1 12.1 A vacancy shall be defined as any unit position, either newly created or a present position, that is not filled, provided the College retain the right to reorganize or discontinue positions. The following are not vacancies: A. Part-time positions that are elevated to full-time B. Positions to be vacant for six (6) months or less; C. Positions vacant for twelve (12) months or less because of medical disability or illness. 12.2 All ESP vacancies shall be emailed posted on the college’s website, given to all the Association President or designee and MEA-ESP members Bulletin Boards. No additional increase on the wage schedule will be given after this trial. The College shall give the employee promoted or transferred ESP member reasonable assistance to enable him/her to perform up to the College's College standards on the new job. If the ESP member employee is unable to demonstrate ability to perform the work required during the trial period or at if the option of the affected ESP memberemployee so desires, the ESP member then he/she shall be returned to his/her previous assignment, if the position is still available. 10.4 12.6 If the College requests an employee is transferred to transfer to a position outside lower classification, other than for the ESP andemployee’s job performance, thereafter, within six (6) months is transferred back to a position within the ESP, seniority shall accumulate while working in the position to which he/she was transferred. Qualified part-time employees may be selected for extra assignment/ additional hours when doing so will not prevent them from fulfilling their original part- time assignment. The College’s selection from this list may be made without regard to seniority. The additional short-term assignment shall not affect benefits status. There will be no change in pay as long as the employee’s pay is contained within the pay band of the assignment. 12.10 New employees shall be required to serve a period not to exceed ninety (90) working days, new job classifications and vacancies, in any manner, which it calendar day probationary period. Said probationary period may deem necessary, until such openings are filled, pursuant to the provisions of this Article. This time frame may, due to extenuating circumstances, be extended upon for Union employees with mutual agreement consent of the partiesUnion and the College. 10.8 Any ESP member12.11 New hires must remain in their new position(s) a minimum of twelve (12) months before voluntarily changing positions within the College. Employees who voluntarily receive promotions or transfers must remain in their new position(s) a minimum of six (6) months unless another transfer would result in a promotion or increase from part-time to full-time. Involuntary transfers or positions resulting from bumping and layoff shall have the above time requirements waived. The above time requirements may be waived by the College. 12.12 If an employee voluntarily applies for, who temporarily assumes is granted, and accepts a transfer, promotion or demotion the duties of another ESP member for fifteen (15) or more consecutive working days, will be paid the regular rate of pay for those duties retroactive to the first date of assuming those duties. An ESP member's employees pay rate shall not be reduced as adjusted accordingly if necessary when he/she begins the result of any temporary change in duties. 10.9 The need for temporary ESP positions new position, and the employee shall be communicated, placed in writing, to the ESP Team Leaderappropriate pay band.
