Common use of Vacation Pay on Termination Clause in Contracts

Vacation Pay on Termination. An employee terminating her employment at any time in her vacation year before she has had her vacation shall be entitled to a payment in lieu of such vacation so that she will receive payment for any unused vacation to which she was entitled in the current vacation year and a proportion of the vacation pay to which she would have been entitled in the following vacation year. The proportion shall be based on the number of months worked by the employee in the year of termination divided by twelve (12).

Vacation Pay on Termination. The proportion shall be based on the number his anniversary date of months worked by the employee in the year of termination divided by twelve (12)employment.

Vacation Pay on Termination. An employee terminating her employment at any time in her the vacation year before she has had her vacation year, prior to using her/his vacation, shall be paid vacation pay for the period s/he is entitled to a payment under the Employment Standard's Act, or vacation pay in lieu the amount of such vacation so that she will receive payment for any unused two per cent (2%) of her/his earnings since the preceding April 1st in respect of each week of vacation to which she s/he was entitled in on such April 1st but had not taken at the current vacation year and a proportion time of termination, whichever is the vacation pay to which she would have been entitled in the following vacation year. The proportion shall be based on the number of months worked by the employee in the year of termination divided by twelve (12)greater.
