WARRANTY OF COMPLIANCE. 3.1 In terms of this agreement the Mandatary warrants that he / she agrees to the arrangements and procedures as prescribed by the Client and as provided for in terms of Section 37(2) of the OHS Act for the purposes of compliance with the Act.
3.2 The Mandatary further warrants that he / she and / or his / her employees undertake to maintain such compliance with the OHS Act. Without derogating from the generality of the above, or from the provisions of the said agreement, the Mandatary shall ensure that the clauses as hereunder described are at all times adhered to by himself / herself and his / her employees.
3.3 The Mandatary hereby undertakes to ensure that the health and safety of any other person on the premises is not endangered by the conduct of his / her activities and that of his / her employees.
WARRANTY OF COMPLIANCE. 4.1 In terms of this Agreement the Mandatary warrants that he agrees to any of the arrangements and procedures as prescribed by the Employer and as provided for in terms of Section 37(2) of the OHS Act for the purposes of compliance with the OHS Act.
4.2 The Mandatary further warrants that he and/or his employees undertake to maintain such compliance with the OHS Act. Without derogating from the generality of the above, nor from the provisions of the said Agreement, the Mandatary shall ensure that the clauses as hereunder described are at all times adhered to by himself and his employees.
4.3 The Mandatary hereby undertakes to ensure that the health and safety of any other person on the premises is not endangered by the conduct of his activities and that of his employees.
WARRANTY OF COMPLIANCE. By signing this Agreement, Applicant represents and warrants that any product or component it identifies during Application and submits for certification meets the applicable MISMO Standards at the time of submission for certification. Applicant further agrees to maintain each Certified Product so that it complies with the MISMO Standards throughout the applicable Certification Period, in accordance with the Program Documentation. If the Applicant fails to ensure continued compliance with the applicable MISMO Standards, MISMO may revoke the product or component’s certification as well as Applicant’s right to continue to use the Compliance Certification Xxxx.
WARRANTY OF COMPLIANCE. In addition to fulfilling the warranties set forth in Section 10.2.4, all Services and Developed Systems shall comply in all material respects to (a) the Technology Proposal (as it may be amended from time to time), (b) Specifications, (c) Documentation, (d) applicable Service Levels, and (d) the Parties' discussions, as embodied in written and approved design and functional layout documents.
WARRANTY OF COMPLIANCE. 2.1 In terms of the agreement the Mandatary warrants that he/she agrees to the arrangements and procedures as prescribed by the Client and as provided for in terms of Section 37(2) of the OHS Act for the purposes of compliance with the Act.
2.2 The Mandatary further warrants that all responsible persons and all employees undertake to maintain such compliance with the OHS Act. Without derogating from the generality of the above, nor for the provisions of the said agreement, the Mandatary shall ensure that the clauses as hereunder described, are at all times adhered to by our employees.
2.3 The Mandatary hereby undertakes to ensure that the health and safety of any person on the premises is not endangered by their conduct on the premises.
WARRANTY OF COMPLIANCE. 3.1. In terms of this Agreement the Mandatary warrants that he has familiarized himself with the working environment and Premises and that he agrees to the Arrangements and Procedures, as prescribed by the Client, and as provided for in terms of Section 37(2) of the OHS Act, for the purpose of compliance with the OHS Act.
3.2. The Mandatary acknowledges that this Agreement constitutes an agreement in terms of Section 37(2) of the OHS Act, whereby all responsibility for health and safety matters relating to the work that the Mandatary and the Employees are to perform on the Premises shall be the obligation of the Mandatary.
3.3. The Mandatary further warrants that he and/or the Employees undertake to maintain all necessary compliance with the OHS Act. Without derogating from the generality of the above, nor from the provisions of this Agreement, the Mandatary shall ensure that the clauses as hereunder described are at all times strictly adhered to by himself and the Employees.
3.4. The Mandatary hereby undertakes to ensure that the health and safety of any person on the Premises is not endangered by the conduct and/or activities of the Employees whilst they are on the Premises.
WARRANTY OF COMPLIANCE. In terms of this agreement the Mandatory warrants that he understands and agrees to the arrangements and procedures as prescribed by the Employer; as provided for in terms of Section 37(2) of the OHS Act for the purposes of compliance with the Act. The Mandatory acknowledges that this agreement constitutes an agreement in terms of Section 37(2) of the OHS Act, whereby all responsibility for health and safety matters relating to the work that the Mandatory and his employers are to perform on the premises shall be the obligation of the Mandatory. The Mandatory further warrants that he and/or his employees undertake to fully comply with the OHS Act. Without derogating from the generality of the above, or from the provisions of the said agreement, the Mandatory shall ensure that the provisions of this agreement and the OHS Act are at all times adhered to by himself and his employees. The Mandatory shall ensure that the health and safety of any person on the premises is not endangered by the conduct and/or activities of any of his employees on the premises.
WARRANTY OF COMPLIANCE. LANDLORD hereby warrants and represents to TENANT that when possession of the Leased Premises shall be delivered to TENANT, the construction of the Leased Premises and the Building and the use of the same for business offices shall be in full compliance with all laws, ordinances, codes and regulations of all Governmental Authorities (as hereinafter defined) and insurance rating bureaus having jurisdiction (including, without limitation, zoning and building codes) and shall not violate the rights of any third parties. As used in this lease the term "Governmental Authority" shall mean the United States, State of New York, and any political subdivision thereof, and any agency, department, commission, board, bureau or instrumentality of any of them.
WARRANTY OF COMPLIANCE. 4.1 In terms of this Agreement the Contractor warrants the familiarisation with the working environment and conditions of the Client, and agrees to the arrangements and procedures as prescribed by the Client, as provided for in the OHS Act.
4.2 The Contractor acknowledges that this Agreement also constitutes an agreement in terms of Sections 8, 13 and 14 of the OHS Act, whereby all responsibilities for health and safety matters relating to the Work that the Contractor and the Employees are to perform at the Workplace remains the obligation of the Contractor.
4.3 In accordance with the provisions of Section 10(4) of the OHS Act, the Contractor accepts liability for ensuring that the necessary steps are taken to ensure that any article or substance that is erected or installed at the Workplace or manufactured, sold or supplied to or for the Client, and which the Contractor uses at or for the Work, complies with all prescribed standards and requirements and will be safe and without risks to health and the environment when appropriately utilised.
4.4 The Contractor further warrants that it and/or the Employees undertake to maintain all necessary compliance with the OHS Act. Without derogating from the generality of the above, or from the provisions of this Agreement, the Contractor shall ensure that the clauses as hereunder described are at all times adhered to by it and the Employees.
4.5 The Contractor hereby undertakes and warrants that it would take all reasonable and practical measures to ensure that the health and safety of any other person at the Workplace is not endangered by its and/or its Employees acts or omissions whilst they are at the Workplace and rendering or executing the Work.
WARRANTY OF COMPLIANCE. GRANTOR represents, warrants, and covenants to DISTRICT that GRANTOR’s use of the Property shall comply with all environmental laws, as defined below. If at any time after the Effective Date of this Easement there occurs a release, discharge, or other incident in, on, or about the Property of any substance now or hereafter defined, listed, or otherwise classified pursuant to any federal, state, or local law, regulation, or requirement as hazardous, toxic, polluting, or otherwise contaminating to the air, water, or soil, or in any way harmful or threatening to human health or the environment, GRANTOR agrees to take all steps that are required of GRANTOR under federal, state, or local law necessary to ensure its containment and remediation, including any cleanup.
