Website Design Development. StickySites and Client undertake to work together to complete website within the timescale defined prior to work starting. StickySites will periodically inform client on project progress and endeavor to meet the defined milestones. Client must supply all required materials BEFORE or within two days of the project start date to avoid development delays. Extended delays in communication (without prior notice) or failure to provide required materials by posted deadline will result in project cancellation. Website Design Development a. Specification of a website design or development project is laid out in the Development Agreement, Push Logic Ltd shall provide website design and development services based on this specification. Push Logic Ltd agrees to build and/or develop the relevant website in accordance with this specification. In the event of a dispute arising as to whether the website satisfies the specification, Push Logic Ltd’s decision shall be final and binding. b. The Customer shall provide to Push Logic Ltd in a timely and suitable manner and in a format requested by Push Logic Ltd, such information as may be reasonably necessary to enable us to complete the website in accordance with the agreed specification, provided that the customer shall not supply any information which infringes the Intellectual Property Rights of a third party or is fraudulent, offensive, abusive, defamatory, obscene or menacing or causes annoyance, inconvenience or needless anxiety or constitutes unsolicited advertising or promotional material. c. The customer unconditionally guarantees that any element of text, graphics, music and/or the customer content/data or other artwork furnished to Push Logic Ltd for inclusion in the website is owned by the customer, or that the customer has permission from the rightful owner to use each of these elements, and will hold harmless, protect and defend Push Logic Ltd and its subcontractors from any claim or suit arising from the use of such elements furnished by the customer. d. Push Logic Ltd shall convert the Information and/or customer content/data into a display-ready format for the website, to meet the specification. e. If the Information and/or customer content/data is not in a suitable digital format, as agreed between Push Logic Ltd and the customer, an additional charge will be made for its conversion. f. Push Logic Ltd may agree to carry out such changes to the website as the customer reasonably requires, provided that the cost of such changes shall be in addition to the charges and shall be paid by the customer where the changes are required as a result of the customer’s desire to depart from the specification. g. All features, functionality and any other work required by the customer that are in addition to the original specification outlined in the Development Agreement will be chargeable at the current hourly development rate or a fixed price where appropriate. h. To be effective, services and activities provided or made available as part of the Proposed Project should have policies and procedures in place and include with the application as an attachment that: 1. Delineate the timely provision of services; 2. Deem Client eligibility and service provision as soon as possible and no later than 30 calendar days from initial request; 3. Require staff to assess and prioritize Client needs; 4. Implement with model fidelity to an evidence-based program or based upon best available research; 5. Plan in partnership with the person and are inclusive; 6. Provide in an environment that is most appropriate and based on a person’s preference including reasonable clinic/reception wait times that are not a barrier to care; 7. Provide referral sources for Clients that cannot be served or receive a specific service; 8. Are culturally and linguistically sensitive; 9. Tailor services to a person’s unique strengths and needs; 10. Manage funds to ensure established Clients continuity of care throughout budget year; 11. Continue to provide services to established Clients after allocated funds are expended; 12. Have processes to identify and eliminate possible barriers to care; 13. Do not deny services due to inability to pay; 14. Have appropriate key personnel and required staff to meet the medical and health needs of Clients; 15. Bill services appropriately and timely through TMHP; 16. Effectively communicate and document information related to health care needs with next steps available to Client; 17. Establish outreach and education plan for the community; and 18. Outline successful delivery of direct clinical services to Clients By submitting an Application under this RFA, the Applicant certifies that Applicant has or will have at time of grant award services, policies, or procedures that conform with the requirements in this section as applicable. HHSC, in its sole discretion, may request to review relevant documentation during the project period as necessary to ensure program fidelity.

  • Program Development NWESD agrees that priority in the development of new applications services by XXXXX shall be in accordance with the expressed direction of the XXXXX Board of Directors operating under their bylaws.
