Common use of Witness and Jury Duty Clause in Contracts

Witness and Jury Duty. When an employee is called to serve as a juror or is subpoenaed as a witness, they shall be compensated for the difference between the payment received for such jury or witness duty, and the payment they would have received at their basic hourly rate, unless such duty payment is the greater of the two. Employees are required to return to work on those regular work days where attendance is not required at the courts or where only a portion of the day is spent serving as a juror or witness, providing there is 1-1/2 hours or more remaining in their tour of duty. In any event, no employee shall be expected to work more than the combined total of hours included in their normal work day, except in the case of necessary overtime.
