WORKING WITH CHILDREN CHECKS. 16.1 Where an employee is obliged to obtain a working with children check in accordance with the Working With Children (Criminal Record Checking) Act 2004, payment for the check shall be as follows: (a) An employer must pay the cost for an employee obliged to obtain a working with children check after their employment has already commenced. (b) A new employee must pay for their initial working with children check. An employer has the discretion to reimburse a new employee who commenced employment after 1 January 2006 and has paid for their initial working with children check. (c) An employer must pay the cost for an employee’s working with children check renewals. 16.2 The provisions of this clause apply to all employees, including fixed term contract and casual employees.

WORKING WITH CHILDREN CHECKS. According to the Child Protection (Working with Children) Xxx 0000, all employees engaged in child related work must have a Working with Children Check clearance. You as an employer are required to verify the status of all employees, volunteers and students before placing them in contact with children. You will only commence employing or continue to employ staff for child related work who have the appropriate Working With Children Check (WWCC) clearance. You as the employer are also required to undertake a current National Criminal Record Check on all new candidates in addition to completing the WWCC process, especially for positions that have direct unsupervised contact with clients and client records. It is also your responsibility to maintain records of the WWCC clearance and to provide a copy of such records to Juvenile Justice for all employees, volunteers and students engaged in child related work under this agreement. WORKING WITH CHILDREN CHECKS. 11.1 This Special Condition applies if the Licensee’s activities at the Premises involve persons engaged in ‘child-related work’ within the meaning of the Worker Screening Act 2020 (Vic) (WSA). 11.2 Without limiting the Licensors’ obligations concerning compliance with all laws and requirements of any authority in connection with the Facility and the Licensee’s use and occupation of the Facility, the Licensee must: 11.2.1 ensure that all the Licensee’s employees, contractors, agents and volunteers over the age of 18 years undertaking 'child-related work’ within the meaning of the WSA hold a valid working with children check under the WSA (Check) before entering onto the Premises; 11.2.2 ensure that any employee, contractor, agent or invitee who is required to hold a Check under the WSA and does not hold a valid Check does not enter the Facility; and 11.2.3 provide the Licensor with such evidence of the Licensee’s compliance with this Special Condition 11 as may be required by the Council, within 5 Business Days of a request being made by the Council. 11.3 This Special Condition 11 is an essential term of this Licence Agreement.

WORKING WITH CHILDREN CHECKS. 12.1 This clause applies if the Hiree’s activities at the Facility involve persons engaged in ‘child- related Work’ within the meaning of the Working with Children Xxx 0000 (Vic) (WWCA). 12.2 Without limiting the Hiree’s obligations concerning compliance with all laws and requirements of any authority in connection with the Facility and the Hiree’s use and occupation of the Facility, the Hiree must: 12.2.1 ensure that all the Hiree’s employees and volunteers over the age of 18 years hold valid working with children checks under the WWCA (Check) before entering onto the Facility; 12.2.2 ensure that any employee, contractor, agent or invitee does not hold a valid Check does not enter the Facility; and 12.2.3 provide the Hirer or the Council with such evidence of the Hiree’s compliance with this clause 12 as may be required by the Hirer or Council, within five business days of a request being made by the Hirer or the Council. 12.3 This Special Condition 12 is an essential term of this Licence.

Without notice to or assent by any Assignor, the Collateral Agent may, upon the occurrence and during the continuance of an Event of Default, apply any or all amounts then in, or thereafter deposited in, the Cash Collateral Accounts which application shall be effected in the manner provided in Section 7.4 of this Agreement. The reasonable costs and expenses (including reasonable attorneys' fees) of collection, whether incurred by an Assignor or the Collateral Agent, shall be borne by the relevant Assignor. The Collateral Agent shall deliver a copy of each notice referred to in the preceding clause (y) to the relevant Assignor, provided, that the failure by the Collateral Agent to so notify such Assignor shall not affect the effectiveness of such notice or the other rights of the Collateral Agent created by this Section 3.3.
