Child Protection. Barracudas’ staff have a duty to respond if they suspect a child may be suffering from or makes a disclosure about abuse. In this event staff will contact the relevant local authority and act on their advice.
Child Protection. The Contractor acknowledges that it (and its personnel) are aware of the requirements of the Child Protection (Working with Children) Act 2012 (NSW) and all related laws concerning child protection (Child Protection Laws). The Contractor will ensure that it (and its personnel) comply with the requirements of the Child Protection Laws and policies of the DoE relating to child protection as notified to the Contractor from time to time. The Contractor must, at the Contractor’s expense, certify that the Contractor and the Contractor’s personnel are not a prohibited person under any Child Protection Laws and undergo any other screening, such as the ‘Working with Children Check’, as required under Child Protection Laws or by the School (or DoE). Any of the Contractor’s personnel that is a prohibited person under any Child Protection Laws must not be engaged in providing any Services. The Contractor is to immediately advise the Department if it becomes aware that it (or its personnel) are the subject of a reportable allegation involving children.
Child Protection training The Contractor must not provide any Services until the Contractor and its personnel have completed the Department of Education’s (DoE) Mandatory Child Protection Training online, or a suitable alternative training program delivered by the Contractor for its staff (see Attachment A).
Child Protection. 14.1 The Grantee will not engage in any practice inconsistent with the rights set forth in the Convention on the Rights of the Child. The Grantee will undertake to protect children from abuse of all kinds in the implementation of the Activity. This provision in its entirety shall be incorporated into all sub-grants to eligible sub-Grantees.
Child Protection. The Contractor represents and warrants that neither it, nor any of its suppliers is engaged in any practice inconsistent with the rights set forth in the Convention on the Rights of the Child. This includes, among other things, Article 3 which requires the best interests of the child to be a primary consideration in all actions concerning children; Article 32 which protects children from economic exploitation and child labour; and Article 34 which protects children from sexual exploitation and abuse. Where the Contractor is providing services directly related to or involving children, the Contractor will either have its own Child protection policy in place or use its best endeavours to act in accordance with the principles of SPC’s child protection policy. The Contractor agrees to bring allegations of any abuse or exploitation of children arising in relation to the Contract, of which the Contractor has been informed or has otherwise become aware, promptly to the attention of SPC. Any breach of this representation and warranty shall entitle SPC to terminate the Contract immediately upon notice to the Contractor, at no cost to SPC. Human rights The Contractor is committed to respecting, and acting in a manner which avoids infringing on, human rights, and ensures that they are not complicit in human rights abuses committed by others. Any breach of this representation and warranty shall entitle SPC to terminate the Contract immediately upon notice to the Contractor, at no cost to SPC. Gender equality and social inclusion SPC is committed to progress gender equality and social inclusion in all area of its work. The Contractor is expected to respect gender equality and diversity in the workplace. The Contractor is expected to have measures in place to ensure equal pay for work of equal value, to prevent bullying and any forms discrimination; and to ensure a safe workplace environment for women and men of all diversities. Sexual harassment, sexual abuse or sexual exploitation SPC will not tolerate any form of sexual harassment, abuse or exploitation. As per Chapter XI of SPC’s Manual of Staff Policies, the Contractor shall refrain from and shall take all reasonable and appropriate measures to prohibit its employees or other persons engaged and controlled by it from engaging in sexual harassment, sexual abuse and sexual exploitation. Child Protection. 23.1 You, your Personnel and your subcontractors must comply at all times with DFAT’s and our Child Protection policies and procedures, including undertaking individual criminal records checks at your own cost.
23.2 You are responsible and accountable to us for preventing and reporting any child abuse or exploitation or suspected child abuse or exploitation as part of your routine responsibilities.
23.3 This Clause 23 is a fundamental term of the Agreement, and breach of this Clause 23 shall:
(a) entitle us to take any action to the maximum extent permitted by law to prevent any abuse or exploitation of children (if capable of prevention) by your Personnel or subcontractors and recover all and any damages from you, and
(b) entitle us to terminate this Agreement immediately without notice and make no compensation to you for such termination.
23.4 You must advise DT Global immediately in writing if any your Personnel or subcontractor Personnel are accused of, charged with, arrested for, or convicted of, criminal offences relating to child abuse or exploitation. We or the Donor may require your Personnel or subcontracted Personnel to be suspended from duty or transferred to other duties during formal investigations relating to child abuse or exploitation. The Contractor must comply promptly with any such notice.
Child Protection. We have an obligation to report to the relevant authorities any child protection concerns, and we may do without your consent and / or without informing you.
Child Protection. The Contractor acknowledges that, under the Donor Contract, the recipients of funds are required to have a robust child protection policy and mechanisms to monitor its adherence and that it is important that a focus on child protection is maintained throughout the lifecycle of the Project. The Donor reserves the right to ask for the relevant child protection policy and mechanisms and test that they are implemented during the life of the Project.
Child Protection. In the event that the hiring involves the attendance of children and young persons under the age of 18 at the premises, the Hirer confirms that there will be in place an appropriate Child Protection Procedure. The Hirer agrees to ensure that all adults present on the premises are aware of this Procedure and abide by it. The Hirer confirms that, when necessary under the terms of the Child Protection Procedure, appropriate Criminal Records Bureau checks will be carried out in respect of persons involved with children and young people on the premises during the course of the hiring.
Child Protection. You are responsible for complying with the provisions of the Children & Young Persons (Care and Protection) Act 1998 (NSW), Child Protection (Working with Children) Act 2012 (NSW), Children’s Guardian Act 2019 (NSW) and any other laws which apply to child protection and establish systems for ensuring that You meet these obligations.
