Workplace Safety Insurance. 27.1 Each member covered by this Agreement who is absent on account of injuries received while on duty and who is receiving a pension, salary or wage award from the Workplace Safety and Insurance shall be entitled to be paid the difference between the pension wage or salary award from the Workplace Safety and Insurance Board and his or her current net salary as long as such member remains in the employ of the Niagara Police Board. This shall be applied such that the combination of any WSIB salary or wage award plus the employer top-up shall, in total, equal the net pay of the member's current salary. The non-economic loss portion of any WSIB pension payments shall not be considered as being a salary or wage award, and hence shall not form part of these calculations. Workplace Safety Insurance. 27.1 Each member covered by 22.01 Where an employee is absent as a result of an injury allegedly sustained at work, the Employer shall continue to pay the employee for a period not exceeding six (6) weeks. During this Agreement period the employee shall receive the appropriate net pay as calculated in accordance with the WSIB Net Average Earnings Table.
(a) If the employee is still absent at the end of the six (6) weeks and the Workplace Safety Insurance Board has not rendered its decision on the claim, sick leave credits equivalent to the net pay received in accordance with Article 22.01 will be used from the first day of absence.
(b) Where the employee has no sick leave credits, wages will be discontinued until the Board renders its decision.
(c) If the Board subsequently approves the claim, the employee shall be paid in accordance with the WSIB Net Average Earnings Table and any sick leave credits used in accordance with Article 22.02 (a) shall be credited back to the employee.
(d) If the Board subsequently declines the claim, the Employer shall recover immediately any overpayment that may have occurred.
(a) An employee who is absent on account by reason of injuries received while on duty and who an injury or industrial disease for which an award is receiving a pension, salary or wage award from made under the Workplace Safety and Insurance Board, shall be entitled to be paid receive the difference between the pension wage or salary award from appropriate net pay calculated in accordance with the Workplace Safety WSIB Net Average Earnings Table and Insurance Board and his or her current net salary as long as such member remains in the employ amount of the Niagara Police Board. 22.04 If the Employer so requires, the employee will supply a medical certificate from a legally qualified medical physician for every twenty (20) consecutive working days of absence following the accident or illness and thereafter, until the employee returns to work or until an L.T.D. application is approved, whichever is the later. The Employer shall reimburse the employee for the member as shown in Appendix "A" less those deductions cost of the medical certificate required under Government Statutes, pension plans and as provided for in this Agreement.
27.2 Subject to the terms of this Article, each member covered by this Agreement who is injured as a result upon presentation of carrying out his/her duties shall not be deprived of his/her vacations or statutory holidays as a result thereof, and shall accumulate such vacation credits and statutory holidays as he/she might otherwise receivethe official receipt.

27.2 Subject to the terms of this Article, each member covered by this Agreement who is injured as a result of carrying out his/her duties shall not be deprived of his/her vacations or statutory holidays as a result thereof, and shall accumulate such vacation credits and statutory holidays as he/she might otherwise receive.
27.2.1 Each . No member shall be entitled to accumulate draw benefits under clause while such member is entitled to receive a disability Pension from the float Canada Pension Plan. A member who, as a result of an injury on duty, is required to remain on duty beyond the end of regular scheduled for hospital treatment shall receive lieu time that he/she might otherwise receive for a period as provided in clause or pay calculated at the rate of three (3) months following the injury.

Workplace Safety Insurance. 27.1 Each member covered by this Agreement who (a) If a full-time employee is absent injured on account the job and his/her supervisor excuses him/her from further duty for the balance of injuries received while the shift, the employee's regular rate of pay shall continue for the balance of that shift and there shall be no deduction from sick leave or other credits. (b) If a part-time employee is injured on the job and his/her supervisor excuses the employee from further duty and who is receiving a pensionfor the balance of the shift, salary or wage award from the employee's regular rate of pay shall continue for the balance of that shift.
(a) The Employer shall advance to the employee ninety percent (90%) of the employee's net average earnings, until such time as Workplace Safety and Insurance shall be entitled to be paid benefits are processed, if the difference between the pension wage or salary award from the duration of an approved Workplace Safety and Insurance Board and his or her current net salary as long as such member remains claim exceeds two weeks. The employee must file a separate request for each two week period.
(b) Net average earnings for part-time employees will be calculated based on earnings in the employ twelve (12) month period preceding the accident.
(c) Although there will be no assignment of W.S.I.B. payments, the Niagara Police Board. This shall be applied such that claimant must immediately reimburse the combination Employer upon receipt of W.S.I.B. benefits for any WSIB salary or wage award plus the employer top-up shall, in total, equal the net pay advance of the member's current salary. The non-economic loss portion of any WSIB pension payments shall not be considered as being a salary or wage award, and hence shall not form part of these calculations. A member who does not comply with the provisions of the Workplace Safety & Insurance Act or Regulations thereto and subsequently receives a salary or wage award of an amount less than the prevailing maximum payable due to such non-compliance, shall not receive from the Niagara Police Board the difference between the wage or salary award paid by the Workplace Safety & Insurance Board and his or her current net salary for the said period of six (6) months. 27.2 Subject (d) This provision shall not apply in the event of lump sum or permanent disability awards.
24.03 The Employer shall meet its obligations outlined in the Workplace Safety Insurance Act to the terms re-employ employees who are or have been in receipt of this Article, each member covered by this Agreement who is injured as Workers' Compensation.
24.04 (F/T) A permanent employee on Workplace Safety Insurance benefits shall continue to accumulate seniority for a result maximum period of carrying out twelve (12) months and shall retain his/her duties seniority thereafter, without further accumulation.
24.05 (P/T) Calculation of seniority for part-time employees on Workplace Safety Insurance, (in receipt of benefits) shall not be deprived the average of time worked per week using the preceding six months' work record before the accident. An employee shall continue to accumulate seniority for a maximum period of twelve (12) months and shall retain his/her vacations or statutory holidays as a result thereof, and shall accumulate such vacation credits and statutory holidays as he/she might otherwise receiveseniority thereafter without further accumulation.
27.2.1 Each member shall be entitled to accumulate 24.06 Continuation of Benefits While on W.S.I.B. (F/T) The Employer will continue the float time that he/she might otherwise receive for a Employer's portion of hospital, medical, dental and group life insurance premiums during any period of three (3) months following the injury.
27.2.2 In respect absence on Workplace Safety Insurance to a maximum of members who have been off work and receiving WSIB benefits for less than two (2) consecutive calendar years, within one week of the member's return, the member and the Chief of Police or designee shall mutually agree upon when the vacation credit, statutory holidays and float time shall be taken within the following twelve (12) months, or in the alternative, the member may elect to be paid for same at the rates of pay applicable in the year of accrual.

Workplace Safety Insurance. 27.1 Each Subject hereto, each member covered by this Agreement who is absent on account of injuries received while on duty and who is receiving a pension, salary or wage award from the Workplace Safety and Insurance Board shall be entitled to be paid the difference between the pension wage or salary award from the Workplace Safety and Insurance Board and his or her current net salary as long as such member remains in the employ of the Niagara Police Board. Any member who goes off on WSIB after April 11, 2017 is only entitled to the top up payment referenced in this section 27.1 until such member is entitled to retire with an unreduced pension in accordance with OMERS regulations (35 years of eligible contributions). This shall be applied such that the combination of any WSIB salary or wage award plus the employer top-up shall, in total, equal the net pay of the member's current salary. The non-economic loss portion of any WSIB pension payments shall not be considered as being a salary or wage award, and hence shall not form part of these calculations. A member who does not comply with the provisions of the Workplace Safety & Insurance Act or Regulations thereto and subsequently receives a salary or wage award of an amount less than the prevailing maximum payable due to such non-compliance, shall not receive from the Niagara Police Board the difference between the wage or salary award paid by the Workplace Safety & Insurance Board and his or her current net salary for the said period of six (6) months. For the purpose of this Clause, net pay shall be the pay for the member as shown in Appendix "A" less those deductions required under Government Statutes, pension plans and as provided for in this Agreement.
27.2 Subject to the terms of this Article, each member covered by this Agreement who is injured as a result of carrying out his/her duties shall not be deprived of his/her vacations or statutory holidays as a result thereof, and shall accumulate such vacation credits and statutory holidays as he/she might otherwise receive.
