Common use of Workplace Safety Insurance Clause in Contracts

Workplace Safety Insurance. (a) An employee injured while and as a result of performing Company’s duties will suffer no loss of basic pay on the day the employee was injured providing, in the opinion of the Company or a doctor, the employee was unable to continue working. (b) If an employee is injured in the course of performing work duties assigned by the Company and as a result of such injury is in receipt of payment by the Workplace Safety Insurance Board for time lost, the Company shall pay the difference between the amount received by the employee from the Workplace Safety Insurance Board for lost basic wages and the amount he/she would have received for his/her basic wage had he/she not been injured. Under no circumstances shall the Company continue the make-up of the difference beyond three (3) calendar months from the day the employee became entitled to Workplace Safety Insurance Board payment. Basic pay is defined as the amount received by an employee for seven and one-half (7 1/2) hours work per day or thirty-seven and one-half (37 1/2) hours per week as the case may be, excluding overtime compensation. This Article does not apply to probationary employees. It is understood and agreed that any payment by the Company, which exceeds an amount greater than his basic wage when such an amount is combined with his Workplace Safety Insurance Board payment, then the excess payment shall be refunded to the Company.
