If, during the sixty (60) day warranty period, the Software fails to comply with the limited warranty set forth above, provided you notify Snap-on within such sixty (60) day warranty period, Snap-on shall, at Snap-on's sole option, either: (i) the return the price paid (if any) for the Software; or (ii) repair or replace at no charge, the Software not meeting the Limited Warranty, and which is returned to Snap-on at your expense with a copy of the sales receipt. THE FOREGOING IS SNAP-ON'S ENTIRE LIABILITY AND YOUR SOLE AND EXCLUSIVE REMEDY RELATING TO BREACH OF THE LIMITED WARRANTY. If failure of the Software has resulted from accident, abuse, misuse or misapplication, Snap-on shall have no responsibility whatsoever. WISHWILL's and its suppliers' entire liability and your exclusive remedy for any breach of this limited warranty or for any other breach of this XXXX or for any other liability relating to the SOFTWARE shall be, at WISHWILL's discretion and subject to applicable law, (a) return of the amount paid (if any) for the Site Collection License/Farm License or Server License, or (b) repair or replacement of the SOFTWARE that does not meet the terms of this limited warranty, if and only if the SOFTWARE is returned to WISHWILL with a copy of your receipt. You will receive the remedy elected by WISHWILL without charge, except that you are responsible for any expenses you may incur (e.g., cost of shipping the SOFTWARE to WISHWILL). This limited warranty is void if failure of the SOFTWARE has resulted from accident, abuse, misapplication, abnormal use or a virus. Any replacement SOFTWARE will be subject to the warranty for the remainder of the original warranty period or twenty (20) days, whichever is longer, and WISHWILL will use commercially reasonable efforts to provide your remedy within a commercially reasonable time of your compliance with WISHWILL's warranty remedy procedures.
YOUR EXCLUSIVE REMEDY. 8.1 Except for any refund elected by NCG, you are not entitled to any damages including but not limited to incidental or consequential damages, special or indirect (such as loss of profit, loss of data, loss of goodwill), arising out of or in any way related to the use of or inability to use the Software, the provisions of or failure to provide Support, malfunction due to implementation of any Solution or otherwise under or in connection with any provision of the Agreement.
8.2 NCG's and its partners' entire liability and your exclusive remedy shall be, at NCG's option from time to time, (i) return of the price paid (if any) for the Software, or (ii) repair or replacement of the Software that does not meet the Limited Warranty set forth in Section 7 and that is returned to NCG with a copy of your receipt. You will receive the remedy elected by NCG without charge, except that you are responsible for any expenses you may incur. This Limited Warranty is void if failure of the Software has resulted from accident, abuse, misapplication, abnormal use, or a computer or software virus.
8.3 Neither these remedies nor any Support services offered by NCG are available without proof of purchase from NCG directly or an authorized partner.

YOUR EXCLUSIVE REMEDY. If only one of our products is actually used in this project and that product is proven defective, you will receive, as your sole remedy, MAPEI replacement product for only that specific portion of the original installation requiring replacement.
