OTHER INFORMATION. So long as any amount is available under this Agreement or the Loan Facility or any part thereof remains outstanding or any other sum is payable pursuant to this Agreement, the Borrower will promptly provide to the Facility Agent:
(a) all notices or other documents in relation to the financial condition or business of the Borrower that are made publicly available;
(b) details of any material litigation, arbitration or administrative proceedings, which affect the Borrower as soon as the same are instituted to the knowledge of the Borrower; and
(c) copies of all licences, permits and approvals of all governmental authorities in relation to the Project or parts of the Project (i.e. concerning a phase of construction) and the operation of the Mill. In addition to (a) and (b) above, the Borrower shall inform the Facility Agent during the Construction Period on a monthly basis about the development of the works related to the Project and adherence to the time schedule set out in the Banking Case, in particular, the Borrower shall inform the Facility Agent, if a substantial delay or obstacle or an event, which might result in Construction Cost Overruns, occurs or threatens to occur.
