Passing of the Risk. 6.1 Unless otherwise agreed, the goods shall be deemed sold „ex works“ (”EXW“ pursuant to Incoterms 2010) (readiness for collection). The risk shall pass to the Buyer upon delivery to the forwarding agent, carrier or collector or where the goods are transported by the Seller, upon leaving the Seller’s works or warehouse. Otherwise the Incoterms in the version valid on the date of conclusion of contract apply.
Passing of the Risk. (a) The risk passes to the customer as follows: - in the case of deliveries without assembly, when the goods leave the delivery plant, ready for collection or dispatch is reported. - for deliveries with assembly on the day of acceptance at the customer's premises.

If the goods are ready to be shipped and the shipping or acceptance of the goods or their acceptance by the buyer is being delayed for reason s attributable to the buyer, then the risk shall be passed to the buyer a s per date of advice that the goods are ready for shipment has been dispatched. Upon request of the buyer we shall insure the goods at his cost against the risks specified by him.
