Common use of Testing phase Clause in Contracts

Testing phase. If we grant a free testing phase, Section 5 (Fees and payment) and Section 6 (Terms of payment) shall be generally not applicable during this period. All other provisions of these GTC shall also apply during any free testing phase. We are entitled to refuse or prematurely terminate the testing phase without stating reasons, in particular in cases of obvious misuse or strain going beyond the usual extent – in this case, we will inform you accordingly. If the contract is not cancelled before the end of the free testing phase, it will become a contract subject to payment and this GTC apply in full, including the valid fees and terms of payment as well as the Sections 5. and 6. of these GTC.
