Actual Annual kWh definition

Actual Annual kWh means the AC electricity produced by your System in kilowatt-hours measured and recorded by Provider during each successive twelve (12) month anniversary of your first monthly payment due date plus any carryover. To measure the Actual Annual kWh we will use the Power Monitor or to the extent such services are not available, we will estimate the Actual Annual kWh by reasonable means.
Actual Annual kWh means the AC electricity produced by your System in kilowatt-hours measured and recorded by Operator during each successive twelve (12) month anniversary of your Lease Start Date, as measured by the hardware that Operator or the Dealer/Installer installs and as communicated to Operator by you pursuant to the Communication Requirements (as defined below).

Examples of Actual Annual kWh in a sentence

  • Guaranteed Annual kWh will not be adjusted if the Actual Annual kWh for Production Year 1 exceeds the Guaranteed Annual kWh for Production Year 1.

  • If, at the end of each successive twelve (12) month anniversary of your Subscription Start Date, the Actual Annual kWh is greater than the Guaranteed Annual kWh during such twelve (12) month period, for purposes of this Production Guaranty, YSG will carry over this surplus and may use this surplus to offset a deficit in Actual Annual kWh that may occur in the future.

  • In the event of hardware, communication, or other failure affecting Actual Annual kWh retrievable from the SunPower Monitoring System, Operator will make commercially reasonable efforts to resolve the failure in a timely manner and the calculations in this Section 2 will be adjusted to compensate for such lost data during such period of failure.

  • In the event the Actual Annual kWh for Production Year 1 is less than 90% of the Guaranteed Annual kWh for Year 1, Customer agrees to allow Better Earth Electric to replace or install additional panels so that the Actual Annual kWh for Production Year 1 meets at least 90% of the Guaranteed Annual kWh for Production Year 1.

  • If at the end of a Production Year, the Actual Annual kWh for such Production Year is greater than the Guaranteed Annual kWh for the Production Year, there will be no additional cost to the Customer for this surplus energy.


More Definitions of Actual Annual kWh

Actual Annual kWh means the actual kWh produced by the Solar Garden associated with the size of your Subscription during each year of the Subscription Term, plus any “Excluded Lost Generation”, associated with the size of your Subscription as defined in Section 4, below.
Actual Annual kWh means the AC electricity produced by your System in kilowatt-hours measured and recorded by Sunnova during each successive twelve (12) month anniversary of your first monthly payment. To measure the Actual Annual kWh we will use the Power Monitor or to the extent such services are not available, we will estimate the Actual Annual kWh by reasonable means.
Actual Annual kWh means the AC electricity produced by your System in kilowatt-hours measured and recorded by Provider during each successive twelve (12) month anniversary of your first monthly payment.
Actual Annual kWh means the AC electricity produced by your System in kWh measured and recorded by Sungevity during each Production Year. Sungevity uses the Sungevity Monitoring Service described below to measure the Actual kWh. To the extent such service is not available, we will estimate the Actual kWh by reasonable means, subject to the requirements of Section 3.b below.
Actual Annual kWh means, for any Production Year, the AC electricity produced by the System in kilowatt-hours (kWh).

Table of Contents TBSC shall not have liability under this Limited Production Warranty for lost electricity production due to: (a) damage or destruction to the System not caused by TBSC or its agents (such as a casualty loss like a tree falling on the System); (b) any failure or lost production not caused by a System defect; (c) theft of the System; (d) Force Majeure or damage caused by unforeseeable events; or (e) a breach by Owner of Owner’s obligations under this Contract. TBSC reserves the right to make repairs or upgrades to the System with new or used parts to address issues causing production shortfalls. The make whole payment will constitute Owner’s sole and exclusive remedy with respect to performance of the system and any power generation shortfall. This Limited Production Warranty does not warrant any specific electrical performance of the System other than that described above. The limited warranties do not apply to any lost power production or any repair, replacement or correction required due to the following:
Actual Annual kWh means the AC electricity produced by the System in kWh measured and recorded by Direct Energy Solar during each Contract Year. Direct Energy Solar will use Enphase Envoy monitoring service or to the extent such service is not available, Direct Energy Solar will estimate electricity production through other reasonable means as determined by Direct Energy Solar. If the System has produced power in excess of the Guaranteed Annual kWh for prior Contract Years, then the cumulative excess of prior Contract Years’ production, less the amount of such excess production used to offset any power production shortfalls in prior Contract Years, shall offset any shortfall in a given Contract Year’s power production before calculating any shortfall for purposes of administering this Limited Production Warranty for such Contract Year and if the cumulative excess power production exceeds the given Contract Year’s power production shortfall, the remaining excess shall be carried forward for application in succeeding Contract Years. In connection with this Limited Production Warranty, Direct Energy Solar reserves the right to make repairs or upgrades to the System and in connection therewith to repair or replace parts of the System with new or used parts. Direct Energy Solar shall not have liability under the Limited Production Warranty for lost electricity production due to: (a) damage or destruction to the System not caused by Direct Energy Solar or its agents (for example, casualty loss such as a tree falling on the System); (b) any failure or lost production not caused by a System defect; (c) theft of the System; (d) Force Majeure or damage caused by unforeseeable events; or (e) a breach by Customer of Customer's obligations under this Contract.
