While making use of the Services and Prague/Ruzyne Airport, the User shall also conform to generally binding legal regulations, particularly as regards hygiene, environmental protection, worker safety, fire safety and civil aviation safety, along with organizational norms, fire regulations, technical regulations and guidelines (especially the Traffic Code of Prague/Ruzyne of Airport, the Prague/Ruzyne Airport Emergency Plan, etc.) issued by the Provider concerning or impacting the User's operations.
The Sponsor agrees that it will: 1) house and maintain the equipment in a state of operational readiness on and for the airport; 2) provide the necessary staffing and training to maintain and operate the vehicle and equipment; 3) restrict the vehicle to on-airport use only; 4) restrict the vehicle to the use for which it was intended; and 5) amend the Airport Emergency Plan and/or Snow and Ice Control Plan to reflect the acquisition of the vehicle and equipment.
If the Airport is operated under 49 CFR Part 1542 (Security) and 14 CFR Part 139 (Certification), the Sublessee will comply with all applicable requirements of the Borough's Airport Security Program, Airport Certification Manual, and Airport Emergency Plan.
The Concessionaire shall acknowledge and agree, however, that any Competent Authority may take such steps as deemed desirable to mitigate or prevent any Emergency (including, without limitation, the interruption or suspension of operations at SIA as a result of an Emergency or pursuant to the Airport Emergency Plan), provided that the suspension or closure be temporary and commensurate with the Emergency event.
Throughout the Term of this Agreement, the Concessionaire shall coordinate with the Competent Authority to maintain, revise and implement the Airport Emergency Plan and shall be responsible for the co-ordination of all activities in the event of an Emergency.
The Concessionaire shall guarantee the provision of Airport Services and Commercial services for the entire duration of the Agreement in line with the Terms of Reference, Airport Operation and Maintenance Manual, Key Performance Indicators (KPI), Implementation Plan, Airport Emergency Plan, Masterplan, Environmental Management Plan, Prudent Industry Practice and the Applicable Law, covering all the necessary costs and expenses.
RAP shall, at its expense, provide all ARFF facilities and equipment in accordance with all applicable federal, state, and local regulations including but not limited to 49 CFR Part 139, Airport Certification, 49 CFR Part 1542, Airport Security, the Airport Certification Manual and Airport Emergency Plan.
To the extent Avports’ compliance with any provision of these Airfield Facilities Operating Standards can be demonstrated by reference to any other document required by Law to be maintained by Avports, the Authority or the Lessee, such as the Airport Certification Manual, the Airport Emergency Plan or the TSA-approved Airport Security Program, Avports’ compliance with the relevant provisions of these Airfield Facilities Operating Standards may be demonstrated by cross-referencing any other such documents.
Starting from the date of implementation of this Contract, unless the parties otherwise agree, the Concessionaire is obliged to ensure, or to insure, at its own costs and expenses, the Airport Services (as set forth in Annex 4), throughout the duration of this Contract in compliance with the Standards, Operations and Maintenance Manual, Key Performance Indicators, Airport Emergency Plan, Environmental Management Plan, applicable legislation and conditions.
