Annual Notification of Rights. If the LEA has a policy of disclosing Education Records and/or Student Data under FERPA (34 CFR § 99.31(a)(1)), LEA shall include a specification of criteria for determining who constitutes a school official and what constitutes a legitimate educational interest in its annual notification of rights.

(a) (1), School Unit shall include a specification of criteria for determining who constitutes a “school official” and what constitutes a “legitimate educational interest” in its annual notification of rights, and determine whether Provider qualifies as a “school official.”
Annual Notification of Rights a. The LEA acknowledges that under the Service Agreement, the LEA is responsible for providing appropriate disclosures to students and their parents regarding disclosure of Student Data to Provider and student use of the Services, including any notices required by the COPPA, FERPA, or other Applicable Laws, and that, prior to creation of School Accounts, the LEA will either obtain any parent consent or comply with an applicable exemption from or exception to parental consent requirements for opening School Accounts for students and use of the Service.
b. If XXX is providing Directory Information or any Education Record to Provider, LEA shall:
i. comply with the Directory Information Exemption, including, without limitation, informing parents and eligible students what information the XXX xxxxx to be Directory Information and may be disclosed and allowing parents and eligible students a reasonable amount of time to request that schools not disclose Directory Information about them; and/or
ii. comply with the School Official Exemption, including, without limitation, informing parents in their annual notification of FERPA rights that the Institution defines “School Official” to include service providers and defines “legitimate educational interest” to include services such as the type provided by Provider; or
iii. obtain all necessary parental or eligible student written consent to share the Student Data with Provider, in each case, solely to enable Provider’s operation of the Service.
c. If XXX is relying on the Directory Information exemption, LEA shall not provide information to Provider from any student or parent/legal guardian that has opted out of the disclosure of Directory Information. Provider depends on LEA to ensure that XXX is complying with the FERPA provisions regarding the disclosure of any Student Data that will be shared with Provider.

If the Organization has a policy of disclosing education records under FERPA, the Organization shall include a specification of criteria for determining what constitutes a legitimate educational interest in its annual notification of rights, and determine whether SLP Toolkit qualifies as a school official.

Additionally, XXX represents, warrants and covenants to Provider, as applicable, that LEA has:
a. Complied with the School Official Exemption, including, without limitation, informing parents in their Annual Notification of Rights that the LEA defines “school official” to include service providers such as Provider and defines “legitimate educational interest” to include services such as the type provided by Provider; and/or
b. Complied with the Directory Information Exemption, including, without limitation, informing parents and eligible students what information the XXX xxxxx to be Directory Information and may be disclosed and allowing parents and eligible students a reasonable amount of time to request that schools not disclose Directory Information about them; and/or
c. Obtained all necessary parental or eligible student written consent to share the Student Data with Provider, in each case, solely to enable Provider’s operation of the Service.

If Client is subject to FERPA, then Client shall ensure that its annual FERPA notice designates Provider as a “School Official” pursuant to 34 CFR § 99.31(a)(1)(i)(B) and that, in providing the Services, Provider has a "legitimate educational interest" pursuant to 34 CFR §99.7(a)(3)(iii).

If XXX has a policy of disclosing Education Records and/or Student Data under FERPA (34 CFR § 99.31(a)(1)), LEA shall include a specification of criteria for determining who constitutes a school official and what constitutes a legitimate educational interest in its annual notification of rights. Additionally, XXX represents, warrants, and covenants to Finalsite, as applicable, that XXX has (a) complied with the School Official Exemption, including, without limitation, informing parents in their Annual Notification of Rights that XXX defines “school official” to including service providers such as Finalsite and defines “legitimate educational interest” to include services such as the Services provided by Finalsite; (b) complied with the Directory Information Exemption, including, without limitation, informing parents and eligible students what information XXX xxxxx to be Directory Information and may be disclosed and allowing parents and eligible students a reasonable amount of time to request that schools not disclose Directory Information about them; and (c) obtained all necessary parental, legal guardians’, or eligible student written consent to share the Student Data with Finalsite, in each case, solely to enable Finalsite’s operation of the Services.

Annual Notification of Rights. 1. The Corrections Special School District through the special education case managers will give each eligible offender with a disability annual notice to inform them of:
a. Their rights under the IDEA, the regulations and policies adopted by the District to afford them these rights, and where such policies and regulations may be obtained; and
b. The right to file complaints concerning alleged failures to comply with policies and regulations concerning the confidentiality of information.
Annual Notification of Rights. BCSD will annually notify Parents, Guardians and Adult Students of their rights under the provisions of FERPA (34 CFR Sec. 99.31(a)(1)).
