ASC Indenture definition

ASC Indenture means the Indenture, dated as of May 1, 1995, between ASC and Xxxxx Fargo Bank, National Association (as successor to The First National Bank of Chicago), as amended, supplemented or otherwise modified (including any such modification contained in any notes, officer’s certificates or other operative documents) as of the Closing Date or in accordance with the terms hereof.
ASC Indenture means the Indenture, dated as of May 1, 1995, between ASC and Xxxxx Fargo Bank, National Association (as successor to the First National Bank of Chicago), as supplemented by Supplemental Indenture No. 1 dated as of January 23, 2004, Supplemental Indenture No. 2 dated as of July 6, 2005, Supplemental Indenture No. 3 dated as of July 21, 2008, Supplemental Indenture No. 4 dated as of March 21, 2013, and Supplemental Indenture No. 5 dated as of January 22, 2014, as amended, supplemented or otherwise modified as of the Restatement Effective Date or in accordance with the terms hereof.
ASC Indenture has the meaning set forth in the definition of Company Indentures.

ASC Indenture means that certain Senior Indenture, dated as of May 1, 1995, between American Stores Company, LLC (as successor to American Stores Company) and Xxxxx Fargo Bank, National Association (as successor trustee) (as supplemented by Supplemental Indenture No. 1, dated as of January 23, 2004, the Supplemental Indenture No. 2, dated as of July 6, 2005, and the Supplemental Indenture No. 3, dated as of July 21, 2008).
ASC Indenture means that certain Indenture, dated as of June 28, 1996, with ASC East, Inc., as issuer, and United States Trust Company of New York, as trustee, in respect of the Series A and Series B 12% Senior Subordinated Notes due 2006.

  • Second Lien Indenture means that certain indenture, dated as of October 20, 2016, among the Company, the guarantors from time to time party thereto and U.S. Bank National Association, as trustee and notes collateral agent, relating to the 9.5% Senior Secured Second Lien Notes due 2022 of the Company, as amended, supplemented, restated, converted, exchanged, replaced or modified from time to time;

  • Subordinated Indenture means the Subordinated Note Indenture, dated as of ________ __, 19__, between the Depositor and the Indenture Trustee, as supplemented by the Supplemental Indenture.

  • Existing Indenture means the Indenture dated as of June 30, 1998 among General Partner, Prologis and U.S. Bank National Association (as successor in interest to State Street Bank and Trust Company of California, N.A.), as Trustee.
