Backwards Compatibility definition

Backwards Compatibility or "Backwards Compatible" means that any referenced prior Software Revision Level or Levels of the applicable Software or any referenced prior Equipment Revision Level or Levels of the applicable Equipment, as the case may be, remain fully functional in accordance with and up to the performance levels to which it was performing immediately prior to any such enhancement and/or revision after the integration with the succeeding Software Revision Level or Equipment Revision Level, as the case may be, and that after such integration such prior Software Revision Level or Equipment Revision Level loses no functionality and such succeeding Software Revision Level or Equipment Revision Level interoperates with all such functionalities of such prior Software Revision Level or Equipment Revision Level.
Backwards Compatibility or “Backwards Compatible” means (i) with respect to all Updates, Upgrades and Combined Releases relating to Software, the ability of the greater of (A) each of the prior [***] Major Releases, or (B) the number of Major Releases issued by Vendor within a period of [***] prior to the integration into the Broadband Access Reliance Network of such Update, Upgrade and/or Combined Release relating to Software, to remain fully functional in accordance with and up to the performance levels to which each was performing immediately prior to the integration with such Update, Upgrade and/or Combined Release relating to Software, and the ability of such Update, Upgrade and/or Combined Release to Interoperate and be compatible with all such functionality of such prior Software versions and with all existing in-service Vendor provided Products already installed in the Broadband Access Reliance Network; (ii) with respect to all Updates, Upgrades and Combined Releases (to the extent of that portion of the Combined Release that is the Update or the use of which by Reliance is not optional without losing the benefit of the Update (for these purposes a “New Equipment Release” means collectively such Update and such non-optional portion of such Combined Release) relating to Equipment, the ability of the existing Broadband Access Reliance Network infrastructure to remain fully functional in accordance with and up to the performance levels to which it was performing immediately prior to the integration with the New Equipment Release, and the ability of the New Equipment Release to Interoperate and be fully compatible with all such functionality of such existing infrastructure and (iii) with respect to each of (A) Updates, Upgrades and Combined Releases relating to Software, and (B) New Equipment Releases, the ability of each of the Products set forth in (A) and (B) to comply with the existing interfaces to other third party equipment and software already deployed in the Broadband Access Reliance Network and with respect to which Vendor is already in compliance prior to the introduction of the Products set forth in (A) and (B).
Backwards Compatibility means that if certain components of a Software Product are upgraded, the Software Product will remain compliant with this Fourteenth Amendment and the upgraded Software Product components will inter-operate with all previous components of the Software Product.

  • The Vendor represents and warrants (the "Software Backwards Compatibility Warranty") that each Software Maintenance Release, Software Upgrade and Software Enhancement will be Backwards Compatible.

Equipment/Hardware means Supplier network Equipment/Hardware including but not limited to data processing and similar Equipment/Hardware, and also includes options, accessories and attachments for more basic Equipment/Hardware. Equipment/Hardware includes as a component thereof any Media fixedly embedded therein in that it is not normally replaced except for maintenance and repair. Equipment/Hardware may include in its meaning, depending upon context, a system or systems consisting of tangible Equipment/Hardware and intangible Software. Equipment Modifications means any patch, fix, alteration, improvement, correction, revision, release, new version or any other change to the Equipment that is required to address a field-affecting change, except for Equipment Feature Enhancements.
