The Bulk Oil Cargo Fee Rate and Capital Asset/Loan Fee Rate and the calculation of volumes set forth in Section 3.2 of this Agreement, shall be determined, and from time to time amended, in accordance with the provisions of the Act.
For purposes of Section 3.1, the chargeable quantity of Bulk Oil Cargo in respect of which the Bulk Oil Cargo Fee is payable shall include both free water and water and sediment in suspension (S&W or BS&W).

In addition to the Domestic Cargo Fee, FEC shall pay to County the additional sum of Fifty Thousand and No/100 ($50,000.00) Dollars per year for three (3) consecutive years beginning on January 1, 2012 (payable in four (4) quarterly installments in each of those years) for implementation of a joint marketing program that promotes the Port and the ICTF.

Operator and Alert acknowledge that where an oil handling facility has been designated for purposes of the Act, the Bulk Oil Cargo Fee shall be calculated in the manner set out in section 4.2 and shall be collected and remitted to Alert by the oil handling facility operator.
