Charging Notice definition

Charging Notice means the operating instruction, and any subsequent updates, given by Buyer to Seller, directing delivery of Charging Energy to the Storage Facility to charge at a specific MW rate to a specified Stored Energy Level; provided that any operating instruction shall be in accordance with the Storage Operating Procedures. For the avoidance of doubt, any Buyer request to initiate a Storage Capacity Demonstration Test shall not be considered a Charging Notice.

  • Each Charging Notice issued in accordance with this Agreement will be effective unless and until Buyer’s SC or CAISO modifies such Charging Notice by providing Seller with an updated Charging Notice.

  • If, during the Delivery Term, Seller charges the Facility (i) to a Stored Energy Level greater than the Stored Energy Level provided for in a Charging Notice, or (ii) in violation of the first sentence of this Section 4.8(c), then (x) Seller shall pay Buyer the cost of such Energy associated with such charging of the Facility, and (y) Buyer shall be entitled to discharge such Energy and entitled to all of the CAISO revenues and other benefits (including Product) associated with such discharge.
