Class Counsel Fees and Expenses definition

Class Counsel Fees and Expenses means the legal fees, disbursements, and applicable taxes of Class Counsel;

Class Counsel Fees and Expenses means the amount of USD$400,000, plus HST, to be paid to Class Counsel on account of all work performed in the Action as well as all fees and disbursements in connection with this Action, including, without limitation, any future fees or costs to be incurred in connection with monitoring the Settlement during the Settlement administration process.

Class Counsel Fees and Expenses means Class Counsel’s attorney fees and expenses as set forth in Section III(6).

Examples of Class Counsel Fees and Expenses in a sentence

• Defendants will not oppose Class Counsel’s application for Class Counsel Fees and Expenses in the combined amount of and not exceeding $7,700,000, and Class Counsel shall not be awarded, and shall not accept, any amount of Class Counsel Fees and Expenses exceeding said combined amount.

• If the Court approves a Class Counsel Fees and Expenses Payment of less than the amount authorized to be sought under this Agreement, the remainder will be retained in the Net Settlement Amount.

• Said payments shall fully satisfy and discharge all obligations of Defendants and the Released Parties with respect to payment of the Class Counsel Fees and Expenses and Settlement Class representative service awards.

• As a condition for and prior to making the Up-Front Payment, each Class Counsel shall execute in favor of Defendants, and deliver to Defendants through their counsel Xxxxxxxx & Xxxxx, P.C., a valid and binding written Guarantee of re-payment to Defendants of the full amount of the Up-Front Payment in the event that the award of Class Counsel Fees and Expenses is reversed or modified as a result of any appeals.

• Each party shall have the right to appeal to the extent the award for Class Counsel Fees and Expenses is inconsistent with this Agreement.

More Definitions of Class Counsel Fees and Expenses

Class Counsel Fees and Expenses means the sum of up to One Hundred Fifty Thousand United States Dollars ($150,000) awarded by the Court to Class Counsel for fees and expenses for prosecuting this Action.

Class Counsel Fees and Expenses means the reasonable attorneys’ fees and expenses approved by the Court, to be paid by Defendant.

Class Counsel Fees and Expenses means the amount approved by the Court pursuant to paragraph 12 for payment to Class Counsel as attorneys’ fees, costs, and litigation expenses, or $3,165,000, whichever is less.

Class Counsel Fees and Expenses means the Class Counsel fees and expenses in the amount of $825,000.00 plus GST and QST, as described more particularly in Section XI of this Agreement.

Class Counsel Fees and Expenses means the amount approved by the Court of no more than one hundred and fifty-nine thousand Canadian dollars (CA$159,000) plus GST and QST thereon (calculated at the date of invoicing) in fees, and eight thousand five hundred Canadian dollars (CA $8,500) plus GST and QST thereon for disbursements and expenses, payable by Walmart Canada from the Settlement Amount in respect of all fees, disbursements, and taxes on disbursements or fees requested by Class Counsel, on their own behalf and on behalf of any and all other counsel, experts and/or consultants acting for or engaged by the Plaintiff in relation to the Class Action, as approved by the Court;

Class Counsel Fees and Expenses means (a) payment to Settlement Class Counsel of fees, costs and expenses to be paid from the Settlement Proceeds in an amount to be determined by the Court; (b) payment of a Class Representative Fee, also known as a case contribution award or incentive award to be paid from the Settlement Proceeds, in an amount to be determined by the Court; (c) payment of expert and consulting fees and expenses and litigation expenses to be paid from the Settlement Proceeds, all in amounts to be determined by the Court. Class Counsel Fees and Expenses shall be paid within five (5) days from and after the date the Judgment becomes Final and Non-Appealable.

Class Counsel Fees and Expenses has the meaning set forth in Paragraph 10(d) of this Settlement Agreement.
