For most Highlands municipalities, the deadline for submission to COAH was extended to June 8, 2010.
Both the RMP and Highlands Council instructions concerning submission of Master Plan Housing Elements and Fair Share Plans, sought municipal participation in a three-step process, intended to culminate in the submission of fully developed affordable housing plans to both the Highlands Council and the Council on Affordable Housing (COAH) (or alternatively the Highlands Council and the Superior Court).
Since COAH failed to do so, the New Jersey Supreme Court established a process for determining regional fair share affordable housing obligations for municipalities and reviewing municipal housing elements and fair share plans to determine whether those plans can be granted approval akin to “COAH substantive certification” by the courts.
Comments: Verification by Program Administrator that all households are income eligible, that appropriate Verification by Building Code Official that units were below code and raised to code per theaffordability controls are in place and that rental prices conform to COAH regulations.
The purpose of this Ordinance is to amend various sections of the Township Land Development Ordinance as a result of the New Jersey Superior Court Appellate Division finding that the Council on Affordable Housing’s attempts in developing Third Round Rules were invalid and ordered COAH to prepare rules that utilized methodologies similar to First and Second Round Rules for determining a municipality’s regional fair share affordable housing obligation.
