Company Option Period definition

Company Option Period has the meaning set forth in Section 10.3(d)(ii).

• If the Company desires to purchase any of the Offered Shares, it shall notify the Employee of such election during the Company Option Period, stating the number of Offered Shares it desires to purchase.

• The failure of the Company to respond within the Company Option Period shall be deemed to be a waiver of the Company’s rights under this Section 2.2(b), provided that the Company may waive its rights under this Section 2.2(b) prior to the expiration of the Company Option Period by giving written notice to the Transferring Stockholder, with a copy to the Investors.
