Subject to this Section 2.7, to the extent CRRA determines that it cannot accept the Municipality’s Solid Waste at either Designated Facility (or both), CRRA shall first redirect Spot Waste, Contract Waste and other Solid Waste not covered by any Municipal Solid Waste Management Services Agreement, which in each case CRRA has the right to so redirect without penalty or incurring any cost, to an Alternate Facility.
This Agreement with its exhibits constitutes the entire agreement between the Parties with respect to the transportation and delivery of Interruptible Contract Waste hereunder, and contains all of the terms and conditions thereof, all prior agreements and understandings whether oral or written having been merged herein.
Accordingly, if any Council fails to deliver its Minimum Tonnage guarantee of Contract Waste in any year, such Council shall still be liable for its Minimum Payment.
The maximum amount of e-waste that may be transported using Combined State Contract Waste Mobilization is the equivalent of 2 shrink wrapped pallets or 2 cubic yard boxes of e-waste.
The Councils acknowledge that their commitment to a Minimum Payment for Contract Waste remains whether they consider alternative waste collection or recycling programmes and that pursuant to Clause 4A.1 (Minimum Payment and Maximum Tonnages) each Council shall be liable for its Minimum Payment.
