Accordingly, if any Council fails to deliver its Minimum Tonnage of Contract Waste in any year, such Council shall still be liable for its Minimum Payment ('PUCBE y') as calculated in accordance with paragraph 3.2 of Schedule 11 (JWA2 Payment Mechanism) to the extent caused by its failure to deliver its share of Contract Waste.
If the terms of the permitting system are agreed by the Parties and an Authority Change is carried out by the Contractor, any such Waste delivered to the HWRCs under such permitting system shall thereafter be treated as Contract Waste.
