Covered Third Party Accused Products means Third Party products and services that include as an element thereof any Licensed Affymetrix Products.
Covered Third Party Accused Products means Third Party products and services that include as an element thereof any of Siemens’ current bead products to which nucleic acids are or may be attached or a natural evolution thereof.
Covered Third Party Accused Products means (i) Accused Luminex Products sold by a third party distributor as is on a standalone basis and with no substantive modification thereto; (ii) Third Party products and services that include as an element thereof any of Luminex’s current microsphere products to which nucleic acids are or may be attached or a natural evolution thereof, Luminex’s MultiCode isobase chemistry, or assays performed using Luminex’s ARIES DNA/RNA extraction cassettes on Luminex’s ARIES instruments (as reflected in, for example, Luminex’s ARIES HSV 1&2 technology) or natural evolutions thereof; and (iii) any products named in Enzo’s Infringement Contentions and Infringement Charts to Abbott Laboratories and Abbott Molecular Inc. (collectively “Abbott”) that are accused of infringing the ‘197 patent in the Litigation (“Covered Abbott Accused Products”). For the avoidance of doubt, Covered Third Party Accused Products do not include Roche’s Elecsys® assays.

More Definitions of Covered Third Party Accused Products

Covered Third Party Accused Products means (i) Accused Luminex Products sold by a third party distributor as is on a standalone basis and with no substantive modification thereto; (ii) Third Party products and services that include as an element thereof any of Luminex’s current microsphere products to which nucleic acids are or may be attached or a natural evolution thereof, Luminex’s MultiCode isobase chemistry, or assays performed using Luminex’s ARIES DNA/RNA extraction cassettes on Luminex’s ARIES instruments (as reflected in, for example, Luminex’s ARIES HSV 1&2 technology) or natural evolutions thereof; and (iii) any products named in Enzo’s Infringement Contentions and Infringement Charts to Xxxxxx Laboratories and Xxxxxx Molecular Inc. (collectively “Abbott”) that are accused of infringing the ‘197 patent in the Litigation (“Covered Abbott Accused Products”). For the avoidance of doubt, Covered Third Party Accused Products do not include Roche’s Elecsys® assays.
Covered Third Party Accused Products means Third Party products and services that include as an element thereof any Accused Life ‘180 Product or Accused Life ‘197 Product. “Diagnostic Uses, Applications, and/or Embodiments” means (1) uses, applications, and/or embodiments of in vitro diagnostic assays approved by an applicable governmental authority (e.g., U.S. Food and Drug Administration, or comparable state or non-U.S. body) for use in the applicable territory for determining or assessing a state of health or disease, or a risk of disease, in a human being, in the medical management of a human being, in an animal, or in the medical or commercial management of an animal, but only to the extent actually sold or used for any such approved use; and (2) uses, applications, and/or embodiments for in vitro screening of samples that are approved by an applicable governmental authority (e.g., U.S. Food and Drug Administration, or comparable state or non-U.S. body) for use in the applicable territory for the purpose of assessing suitability for blood and/or tissue banking, but only to the extent actually sold or used for any such approved use. For the avoidance of doubt, any prior, existing, and/or future manufacturing, use, and/or sale of a product that at the time of such manufacturing, use, and/or sale is not for a use, application and/or embodiment within the scope of foregoing (1) or (2) but is subsequently used or sold for a use, application and/or embodiment that is within the scope of foregoing (1) or (2) is within the definition of “Diagnostic Uses, Applications, and/or Embodiments.”

Related to Covered Third Party Accused Products

  • Third Party Product means a product (whether hardware, software or services) supplied to you by a third party;

  • Third Party Products means the Third Party Software and Third Party Hardware.

  • Covered Products means Your Applications, Libraries, Passes, Safari Extensions, Safari Push Notifications, and/or FPS implementations developed under this Agreement.

  • Unlicensed person means any person who is not a licensed dealer under this chapter.

  • Covered Product The consumer product that You purchased concurrently with and is covered by this Agreement.

  • Licensed Product means any method, process, composition, product, service, or component part thereof that would, but for the granting of the rights set forth in this Agreement, infringe a Valid Claim contained in the Licensed Patents.

  • Generic Product means a product which (a) contains as its active pharmaceutical ingredient a compound that is (or is substantially the same as) the Licensed Compound or the active pharmaceutical contained in a Unity Bcl-2 [***] Product, and (b) has been placed on the market pursuant to a validly granted marketing authorization.

  • Licensed Products means tangible materials which, in the course of manufacture, use, sale, or importation, would be within the scope of one or more claims of the Licensed Patent Rights that have not been held unpatentable, invalid or unenforceable by an unappealed or unappealable judgment of a court of competent jurisdiction.

  • Collaboration Product means a pharmaceutical product containing or comprising Compound in any dosage form alone, or in combination with, one or more other pharmaceutically active ingredients, and any and all Improvements thereto.

  • Third Party IPR means any Intellectual Property Rights not belonging to either party to this Agreement but used by the Supplier in the creation of the Deliverables and/or in the course of or in connection with the Project.

  • Third Party IP means the Intellectual Property Rights of any third party that is not a party to this Contract, and that is not a Subcontractor.

  • Diagnostic Product means In Vitro Diagnostics, In Vivo Diagnostic Agents and any product used for Diagnosis.

  • Third Party Providers or “TPPs” means any payment service provider that provides payment services to you or someone else that concerns the Account, for example, an AISP (described in Clause 1(c) below).

  • Third Party Content means all software, data, text, images, audio, video, photographs and other content and material, in any format, that are obtained or derived from third party sources outside of Oracle that You may access through, within, or in conjunction with Your use of, the Services. Examples of Third Party Content include data feeds from social network services, rss feeds from blog posts, Oracle data marketplaces and libraries, dictionaries, and marketing data. Third Party Content includes third-party sourced materials accessed or obtained by Your use of the Services or any Oracle-provided tools.

  • Licensed Compounds means any EZH2 Compound(s) that is:

  • Licensed person means an individual who is licensed or otherwise legally authorized to practice a professional service by a court, department, board, commission, or an agency of this state or another jurisdiction, any corporation or professional services corporation all of whose shareholders are licensed persons, any partnership all of whose partners are licensed persons, or any limited liability company all of whose members and managers are licensed persons.

  • Third Party Provider means licensors, subcontractors and suppliers of BNYM furnishing the Third Party Products.

  • Licensed Compound means (a) 3,4-Diaminopyridine, the chemical structure of which is set forth on Exhibit B-2; and (b) any derivatives, isomers, metabolites, prodrugs, acid forms, base forms, salt forms, or modified versions of such compound in (a).

  • Third Party Material means software, software development tools, methodologies, ideas, methods, processes, concepts and techniques owned by, or licensed to a third party and used by the Service Provider in the performance of the Services;

  • Third Party Manufacturer means (i) a Third Party whose primary business is contract manufacturing, or (ii) a Third Party who has a contractual arrangement with Licensee or with a sublicensee of Licensee that includes manufacturing of Client Product and/or Drug Product by such Third Party for Licensee or such sublicensee.
