Data Privacy Incident definition

Data Privacy Incident means any: a) Disclosure of Personal Data by Supplier in violation of this Security Policy or applicable laws pertaining to data protection or data security, or b) Other unauthorised, accidental or unlawful access, acquisition, disclosure or use of Personal Data that has occurred or may have occurred, including, without limitation, any unauthorised access of which Supplier is notified or suspects.
Data Privacy Incident means any actual, alleged or reasonably suspected:
Data Privacy Incident means any (a) disclosure of Personal Information by Vendor in violation of the Agreement or applicable laws pertaining to privacy or data security, or (b) any other unauthorized access, acquisition, disclosure or use of Personal Information that has occurred or may have occurred, including, without limitation, any unauthorized access of which Vendor is notified or suspects.

Examples of Data Privacy Incident in a sentence

  • If a Data Privacy Incident or Network Intrusion reported to the Insurer during the Policy Period pursuant to Section IV(G) results in covered First Party Expenses under this Policy, then the Insurer will reimburse the Named Insured for Post-Incident Remediation Expense which the Organization incurs within 120 days of the final payment of First Party Expenses as a direct result of the Data Privacy Incident or Network Intrusion noticed under the Policy, as described above.

  • Internal Expense; and At the sole discretion of the Insurer, Incident Response Expenses also means any other reasonable and necessary expenses incurred by the Organization effectuating a response to a Data Privacy Incident or Network Intrusion in order to reduce the likelihood of a Claim being made in connection with such Data Privacy Incident or Network Intrusion.

  • The Insurer will pay Incident Response Expenses on behalf of the Insured which the Organization incurs as a direct result of a Data Privacy Incident or Network Intrusion first discovered by an Executive Officer during the Policy Period and reported to the Insurer pursuant to Section IV(G).

  • Notwithstanding the above, the Organization may agree in writing to waive such right of recovery or subrogation against any person or entity if such waiver was a contractual obligation of the Organization and was executed prior to the Claim, Network Intrusion, Data Privacy Incident or Wrongful Act at issue.

  • The written notification shall include the following: (i) the date of the Data Privacy Incident; (ii) a description of the Data Privacy Incident; (iii) the names of the persons whose Personal Data might possibly have been affected as well as a description of the type of the affected Personal Data; and (iv) any additional information required by law.

  • Privacy Incident means violation of the Minnesota Government Data Practices Act (Minnesota Statutes chapter 13); violation of federal data disclosure or privacy requirements in federal laws, rules and regulations; and/or breach of a contractual obligation to protect State data. This includes, but is not limited to, improper or unauthorized access to, viewing of, obtaining of, acquisition of, use of, disclosure of, damage to, loss of, modification of, alteration to or destruction of State data protected by such State or federal laws or by contract.

A critical incident may involve multiple individuals or results.

  • Data Privacy Laws means any state or national law or regulation protecting the privacy, confidentiality, or security of Personal Information.

  • The HIPAA Privacy Rule means the Standards for Privacy of Individually 10 Identifiable Health Information at 45 CFR Part 160 and Part 164, Subparts A and E.

  • Data Security Incident means a breach of security leading to the accidental or unlawful destruction, loss, alteration, unauthorised disclosure of, or access to, Agreement Personal Data transmitted, stored or otherwise Processed;

  • Cyber incident means actions taken through the use of computer networks that result in a compromise or an actual or potentially adverse effect on an information system and/or the information residing therein.

  • Privacy Breach means a common law breach of confidence, infringement, or violation of any rights to privacy, including but not limited to breach of the Insured’s privacy statement, breach of a person’s right of publicity, false light, intrusion upon a person’s seclusion, public disclosure of a person’s privacy information, or misappropriation of a person’s picture or name for commercial gain.

  • HIPAA Privacy Rule as defined in 45 CFR Part 164, Subparts A and E.

  • Privacy Shield means the EU-U.S. Privacy Shield and Swiss-U.S. Privacy Shield Framework self-certification program operated by the U.S. Department of Commerce and approved by the European Commission pursuant to Decision C(2016)4176 of 12 July 2016 and by the Swiss Federal Council on January 11, 2017 respectively.

  • Minor incident means an occurrence involving a consumer during service provision that is not a major incident and that:

  • Data Provider means a Participant that is registered to provide information to GS1 South Africa for use through the Verified by GS1 Services.

  • Security Incident means any known successful or unsuccessful attempt by an authorized or unauthorized individual to inappropriately use, disclose, modify, access, or destroy any information or interference with system operations in an information system.

  • Data Safeguards means the highest industry-standard safeguards (including administrative, physical, technical, and procedural safeguards) against the destruction, loss, misuse, unauthorized disclosure, or alteration of the JBE Data or Confidential Information, and such other related safeguards that are set forth in Applicable Laws, a Statement of Work, or pursuant to JBE policies or procedures.
