Defective Service definition

Defective Service means any Service not meeting the requirements set out in section 7.3.
Defective Service has the meaning as set out in Section 9.1
Defective Service has the meaning specified in Section 3.3. “Disclosing Party” has the meaning specified in Section 13.1.

Examples of Defective Service in a sentence

  • If, during the course of inspection or otherwise prior to acceptance of any Service in accordance with Section 3.1(d), Owner determines that the Service fails to conform to this Agreement (a “Defective Service”), Owner shall so notify Provider thereof in writing, describing the Defective Service in reasonable detail (a “Defect Notice”).

  • If Provider is obligated under this Section 3.3 to remedy a Defective Service and fails or is unable to do so within a period consistent with Owner’s reasonable requirements, then Owner may undertake to remedy the Defective Service and, if Provider had been obligated to correct the same at its expense, then Provider shall reimburse Owner for any reasonable costs incurred thereby.

  • Provider shall promptly correct or re-perform the Defective Service specified in the Defect Notice so that it conforms to this Agreement at Provider’s own cost and expense, provided, however, that any Defective Service identified after Owner’s acceptance shall be corrected and/or re-performed at Owner’s expense absent Provider’s willful intent to deceive.

Defective Service is defined in Appendix A, section 7 (“Defective Services”).

Related to Defective Service

  • Sensitive Services means those services that (i) require access to Customer/Consumer Information, (ii) relate to the State’s computer networks, information systems, databases or secure facilities under circumstances that would permit modifications to such systems, or (iii) involve unsupervised access to secure facilities (“Sensitive Services”).

  • Supportive services means social, health, educational, income support and employment services and benefits, coordination of community building and educational activities, individualized needs assessment, and individualized assistance with obtaining services and benefits.

  • Toll Billing Exception Service (TBE) means a service that allows End Users to restrict third number billing or collect calls to their lines.

  • Prepaid calling service means the right to access exclusively telecommunications services, which must be paid for in advance and which enables the origination of calls using an access number or authorization code, whether manually or electronically dialed, and that is sold in predetermined units or dollars of which the number declines with use in a known amount.

  • Service Switching Point (SSP) is a telephone central office switch equipped with a Signaling System 7 (SS7) interface.

  • NEW SERVICE means a service, treatment, procedure, facility, equipment, drug, device, or supply we previously have not reviewed to determine if the service is eligible for coverage under this plan. NON-NETWORK PHARMACY is any pharmacy that has not entered into a contract to accept our pharmacy allowance for prescription drugs and diabetic equipment or supplies covered under this plan.
