Defects Date definition

Defects Date a date specified in accordance with Annex D (Service Schedule and Rates) by which date the Service Provider is obliged to remedy each Deficiency in the Service at the own cost and expense of the Service Provider.
Defects Date means the defects date referred to in the Works Terms being: (1) for each Final Year WSP, a separate defects date being the date that is twelve months after the Completion of such Works Sub-Project; and (2) for all other works provided under the Works Terms (including all Works Sub-Projects Completed earlier than eleven months before the Term Expiry Date or earlier termination of the Overarching Terms) a single defects date being the date that is one month after the Term Expiry Date; and, unless stated otherwise, each reference and clause relevant to the Defects Date applies, as the case may be, to either a defects date for a Final Year WSP or the defects date for all other works under the Works Terms;

  • Technical violation means a noncriminal violation of the conditions of parole. This rule is intended to implement Iowa Code section 905.7.

Any condition or situation that results from lack of sufficient generating capacity to meet load requirements or that results solely from economic conditions shall not, standing alone, constitute an Abnormal Condition.

  • Environmental Actions means any complaint, summons, citation, notice, directive, order, claim, litigation, investigation, judicial or administrative proceeding, judgment, letter, or other communication from any Governmental Authority, or any third party involving violations of Environmental Laws or releases of Hazardous Materials from (a) any assets, properties, or businesses of any Borrower or any predecessor in interest, (b) from adjoining properties or businesses, or (c) from or onto any facilities which received Hazardous Materials generated by any Borrower or any predecessor in interest.

  • Environmental Matter means any past, present or future activity, event or circumstance in respect of the environment, health or safety including the Release of any Hazardous Substance including any substance which is hazardous to Persons, animals, plants, or which has a detrimental effect on the soil, air or water, or the generation, treatment, storage, use, manufacture, holding, collection, processing, treatment, presence, transportation or disposal of any Hazardous Substances.

  • Environmental Defect means, with respect to any given Asset, a material violation of Environmental Laws in effect as of the Effective Time in the jurisdiction in which such Asset is located.

  • Environmental Complaint shall have the meaning set forth in Section 4.19(d) hereof.
