Design Plans means design plans, specifications, estimates, surveys, and any necessary studies or investigations, including, but not limited to, environmental, hydraulic, and geological investigations or studies necessary for the Project under this Agreement and as approved by the FAA.

Examples of Design Plans in a sentence

• Service Provider shall not be relieved from the obligation to fabricate and produce the Project and to install the Project in accordance with the Design Plans and Construction Documents by reason of the City’s failure to reject the Project or any component thereof or by any inspections, tests or approvals performed by the City.

• If such termination is due to a substantial variance from the Design Plans and Construction Documents set forth in Exhibit “A”, this Agreement, and/or the International Building Code, 2003 edition, the City shall have the option of paying nothing hereunder and of requiring repayment by Service Provider of any sums previously paid by the City.

• If such inspection or special inspection or testing reveals a failure of the Project or the components thereof to comply with the requirements of the Design Plans and Construction Documents, Service Provider shall bear all costs of the correction of the defective work, including compensation for the City’s additional services made necessary by such failures; otherwise, the City shall bear the costs of such inspection and testing.

• In the event the City does not find the Project, as it progresses, in compliance with the Design Plans and Construction Documents, the City will work to cure discrepancies with the Service Provider within the parameters and scope of the project.

• Whenever the City considers it necessary or advisable for the implementation of the intent of this Agreement, the City will have authority to inspect the Project and to require special inspection or testing of the Project or its components to ascertain whether it is in accordance with the Scope of Services attached as Exhibit “A”, or following the design phase, the Design Plans, and Construction Documents.

Design Plans has the meaning set forth in Section 3.1(c).

Design Plans. The plans and specifications for the Multi-Use Path approved by the FHWA, identified as Exhibit B (for Phase 2A) and Exhibit B-1 (for Phase 2B), which Exhibits B and B-1 are incorporated herein by reference.

Design Plans means the Pedestrian Grade-Separated Crossing Construction Drawings 60% Plan Set with print date of February 5, 2021 approved by a UTA Engineer on March 11, 2021 marked and attached as Exhibit "A”.

Design Plans has the meaning set forth in Section 2.2(a). “Dollars” or “$” means the lawful currency of the United States of America. “Effective Date” has the meaning set forth in the introductory paragraph. “Equipment” means all of the individual items which form part of the permanent or temporary systems of the Century Plant Project, including vessels, pumps, motors, instruments, cables, junction boxes, pipelines, water ▇▇▇▇▇ and valves. “Estimated Change Order Costs” has the meaning set forth in Section 9.1(c). “Estimated Measured Progress for Billing Month” has the meaning set forth in Section 8.2(c). “Estimated Measured Progress for Previous Month” has the meaning set forth in Section 8.2(c). “Excused Delay” has the meaning set forth in Section 3.2(a). “Executive Officer” means, with respect to the Owner, any officer of Occidental Petroleum Corporation with the title of vice president or any title senior to vice president, and with respect to the Construction Manager, any officer of ▇▇▇▇▇▇▇▇▇ Energy, Inc. with the title of executive vice president or any title senior to executive vice president.

Design Plans means the detailed design plans for the construction of the Project to be prepared by the Contractor and approved by the ONTC Representative, including the preliminary design, working drawings and specifications prepared by the Contractor.
