Disqualifying Criminal History definition

Disqualifying Criminal History means: (1) a conviction or other criminal history information designated by HISD; (2) a felony or misdemeanor offense that would prevent a person from being employed under Texas Education Code § 22.085(a), that is: if at the time of the offense, the victim was under 18 or was enrolled in a public school: (a) a felony offense under Title 5, Texas Penal Code; (b) an offense on conviction for which a defendant is required to register as a sex offender under Chapter 62, Texas Code of Criminal Procedure; or (c) an offense under federal law or the laws of another state that is equivalent to (a) or (b).
Disqualifying Criminal History means any conviction of a felony or misdemeanor offense that

  • Contractor or Service Provider agrees that if it receives information that a Covered Employee is arrested or convicted for any of the Disqualifying Criminal History offenses during the performance of this contract, Contractor or Service Provider will immediately remove the Covered Employee from Riviera ISD’s property or other location where students are regularly present, and notify Riviera ISD of said removal within three (3) days of doing so.

  • The Contractor or Service Provider shall certify to Riviera ISD in writing that it has complied with this section and that none of its Covered Employees have a Disqualifying Criminal History on a form provided by Riviera ISD.

  • Contractor agrees that if it receives information that a Covered Employee is arrested or convicted for any of the Disqualifying Criminal History offenses during the performance of this contract, Contractor will immediately remove the Covered Employee from Owner’s property or other location where students are regularly present, and notify the Owner of said removal within three (3) days of doing so.

  • The Contractor shall certify to the Owner in writing that it has complied with this section and that none of its Covered Employees have a Disqualifying Criminal History on a form provided by the Owner.

  • Vendor understands that if an employee subcontractor, or volunteer has a Disqualifying Criminal History, the District may elect not to enter into this Contract or may elect to cancel the Contract.

Disqualifying Criminal History means: a conviction within the last 30 years, related to one or more of the following offenses, if at the time of the offense, the victim was under 18 years of age or enrolled in a public school: (1) a felony offense under Texas Penal Code Title 5 Offenses Against Persons (homicide; kidnapping, unlawful restraint, smuggling of persons, trafficking of persons, sexual offenses; and assault offenses); (2) an offense for which a defendant is required to register as a sex offender under Texas Code of Criminal Procedure Chapter 62; or (3) an equivalent offense under federal law or the laws of another state. Contractor shall assume all expenses associated with obtaining criminal history record information, providing the certification, and performing Contractor’s responsibilities as set out herein.

Section 801 et seq.; an offense involving the illegal transfer, appropriation, or use of school District funds or other District property; or an offense involving an attempt by fraudulent or unauthorized means to obtain or alter a professional certificate or license), Title 5 felony or other offense requiring registration as a sex offender if the victim of the crime was below the age of 18 or enrolled in a public school or an equivalent offense under federal law or the laws of another state, as well as conviction of any felony, or of any misdemeanor involving moral turpitude as defined by Texas law.
