Early Occupancy Period definition

Early Occupancy Period shall have the meaning set forth in Section 3.02 of the Original Lease, and such Early Occupancy Period shall apply to the Expansion Premises.
Early Occupancy Period means the period (if any) specified in Item 7(c) of the Basic Lease Information, during which Tenant can occupy and use the Premises prior to the CLP Commencement Date in accordance with the terms and conditions of Section 3.1.
Early Occupancy Period means the period commencing on the date of Substantial Completion of the Tenant Improvements in the Early Occupancy Premises and continuing until the day immediately preceding the Lease Commencement Date. Landlord and Tenant acknowledge and agree such Early Occupancy Period is not part of, and instead is in addition to, the Lease Term. During such Early Occupancy Period, all of the terms and conditions of the Lease shall apply, including, without limitation, Tenant’s obligation to pay Base Rent and Tenant’s Share of Direct Expenses, as though the Lease Commencement Date had occurred (although the Lease Commencement Date shall not actually occur until the occurrence of the same pursuant to the terms of the Lease, as amended hereby); provided, however, for avoidance of doubt, during the Early Occupancy Period only, Tenant shall pay monthly Base Rent attributable to the Early Occupancy Premises in an amount equal to $120,633.75(i.e., $1.25 per rentable square foot of the Early Occupancy Premises per month) and Tenant’s Share for the Early Occupancy Premises shall mean 61.3%. Further, Tenant hereby acknowledges that Tenant may be in occupancy of the Early Occupancy Premises during the completion of construction of the Tenant Improvements in the Remaining Premises, and in such event, notwithstanding Tenant’s occupancy of the Early Occupancy Premises during the construction of the Tenant Improvements in the Remaining Premises by Landlord, Landlord shall be permitted to construct the Tenant Improvements in the Remaining Premises during normal business hours, without any obligation to pay overtime or other premiums. Tenant shall provide a clear working area for such work, if necessary (including, but not limited to, the moving of furniture, fixtures and Tenant's property away from the area in which Landlord is constructing the Tenant Improvements). Tenant hereby agrees that the construction of the Tenant Improvements shall in no way constitute a constructive eviction of Tenant nor entitle Tenant to any abatement of rent. Landlord shall have no responsibility or for any reason be liable to Tenant for any direct or indirect injury to or interference with Tenant's business arising from the Tenant Improvements, nor shall Tenant be entitled to any compensation or damages from Landlord for loss of the use of the whole or any part of the Early Occupancy Premises or of Tenant's personal property or improvements resulting from the Tenant Improvements or Landlord's actions ...

Examples of Early Occupancy Period in a sentence

  • In consideration of executing this Early Occupancy Agreement, Tenant agrees to indemnify and save Landlord harmless of and from any and all liability, damage, expense, cause of action, suits or claims or judgments resulting from injury to person or property arising from the use of the Premises by Tenant during the Early Occupancy Period, including loss or damage to Tenant, its equipment, materials or supplies.

Landlord agrees to notify Tenant promptly after Landlord learns that any Expansion Space is or will become available. If Tenant exercises this option, Tenant’s Expansion Space will be leased to Tenant in its “as is” condition and Tenant will, at its expense and in compliance with the provisions of Section 7.06, design and construct all Improvements desired by Tenant for its use and occupancy. Landlord and Tenant agree to execute such amendments to this Lease and other instruments as either of them considers necessary or desirable to reflect Tenant’s exercise of this option.

  • Transient occupancy means occupancy in transient lodging that has all of the following

  • Lease Term means the term of this Lease which shall commence on the Commencement Date and continue for the period specified in Section J of the Summary.

  • commencement day means the day on which the State Administrative Tribunal (Conferral of Jurisdiction) Amendment and Repeal Act 2004 Part 2 Division 29 comes into operation;

  • Commercial Premises Means a place of trade or premises operated for financial gain, including but not limited to, a retirement village or a block of flats that has a common facility; a place of trade where the manufacture and production of products or produce takes place; a site where renovation, restoration and refurbishment work as described in Appendix B takes place.
