Examples of ES in a sentence
Customer will compensate Chevron ES for its performance of the Assessment by payment to Chevron ES of a fee (the “Assessment Fee”) in the amount of Forty-Nine Thousand Eight Hundred Seventy-Four Dollars ($49,874).
If this Agreement is terminated by Customer, a fee will be payable by Customer to Chevron ES within thirty (30) calendar days of termination, in an amount equal to the greater of (i) Chevron ES’s estimate of its fees, costs, expenses, disbursements and overhead incurred through the date of termination and (ii) a pro-rated fee based on Chevron ES’s estimate of the percentage of completion of the Assessment.
In no event will Chevron ES be liable to Customer for any Losses which collectively exceed twenty percent (20%) of the Assessment Fee, regardless of whether such amounts arise out of breach of contract, guarantee or warranty, tort, product liability, contribution, strict liability or any other legal theory.
Customer agrees to deliver the Required Information to Chevron ES no later than ninety (90) calendar days after the date hereof.
Chevron ES agrees to complete the Assessment and to present to Customer a Report within one hundred fifty (150) calendar days after the date on which Chevron ES receives the information listed in Part I of Attachment A (the “Required Information”).
