Excluded Uses definition

Excluded Uses means all: 1.1.16.1 orthopedic uses, such as permanent, temporary or transcutaneous implants; 1.1.16.2 veterinary uses; 1.1.16.3 dermatological uses, such as for acne, eczema, impetigo, folliculitis, psoriasis, skin cancer, warts, shingles, minor sunburn, oral herpes, genital herpes, athelete’s foot, jock itch, diaper rash, scalp care (dandruff), infections of nail beds, contact dermatitis, pyoderma, rosacea and dry/chapped skin but not including Toxic Epidermal Necrolysis Syndrome (TENS), Epidermolysis Bullosa (EB), Sxxxxxx-Xxxxxxxx Syndrome which are specifically included in the Field; 1.1.16.4 non-dermal ophthalmology uses, such as eye drops, ointments, creams, and specially designed dressings; 1.1.16.5 pediatric uses, such as diaper rash, otitis media, external otitis, impetigo and thrush; 1.1.16.6 oral and dental uses, such as mucositis, periodontal disease, gingivitis, bad breath, sore throats, tooth infections and thrush; 1.1.16.7 non-dermal ear, nose and throat uses, such as external otitis, otitis media, sore throat, nasal packing, sinusitis, gargles, rinses and spray; 1.1.16.8 surgical supply uses, such as for gowns, non-adhesive drapes, masks, casting materials, fluid collecting devices, sterilization solutions; 1.1.16.9 personal hygiene uses, such as lubricating gels, tampons/pads and for vaginal infections; 1.1.16.10 ostomy and incontinence uses, such as peristomal skin protection, pouch “sterilization”, odor control, diapers and pads, and catheters and bags/bottles; 1.1.16.11 coated medical device uses, such as implants (permanent, temporary and transcutaneous), catheters and dressings designed specifically for use around non-vascular catheters, trocars/vent tubes and other transcutaneous devices, surgical meshes, sutures, staples, heart valves, shunts and stents; 1.1.16.12 respiratory uses such as pneumonia, bronchitis and sinusitis; 1.1.16.13 until such time as the Korean Distribution Agreement expires or is terminated in accordance with Section 2.8.2 of this Agreement, the use, marketing, promotion, distribution or sale in Korea of the products in the field specified in the Korean Distribution Agreement; and 1.1.16.14 until such time as the Japanese Distribution Agreement expires or is terminated in accordance with Section 2.8.1 of this Agreement, the use, marketing, promotion, distribution or sale of the products in the field specified in the Japanese Distribution Agreement;

Excluded Uses means (i) [...***...] (but for the avoidance of doubt, excluding bone marrow (hematopoietic stem cell) transplantation diagnostic testing), (ii) [...***...] applications, (iii) [...***...] for [...***...], [...***...], [...***...], [...***...], [...***...] and [...***...] or [...***...], (iv) [...***...], (v) [...***...], and (vi) use of [...***...] for [...***...].

Excluded Uses means (a) any Commercial Use, (b) any human germline modification, including without limitation modifying the DNA of human embryos, or (c) any use in a manner that is prohibited by applicable laws, rules and regulations.

Examples of Excluded Uses in a sentence

• Additionally, Purchaser is granted a non-exclusive, non-transferable, personal, non- sublicensable license under Seller’s Core IP to install and use Software made available by Seller with the Product, solely in accordance with the Product’s Specifications and Documentation, specifically excluding the Excluded Uses; this license will terminate upon Purchaser’s failure to comply with these terms and conditions, or by Purchaser discontinuing use of the Software and destroying or removing all copies thereof.

• Additionally, Purchaser is granted a non-exclusive, non- transferable, personal, non- sublicensable license under Seller’s Core IP to install and use Software made available by Seller with the Product, solely in accordance with the Product’s Specifications and Documentation, specifically excluding the Excluded Uses; this license will terminate upon Purchaser’s failure to comply with these terms and conditions, or by Purchaser discontinuing use of the Software and destroying or removing all copies thereof.

• Additionally, Purchaser is granted a non-exclusive, non-transferable, personal, non-sublicensable right under Seller’s Core IP to install and use Software made available by Seller with the Product, solely in accordance with the Product’s Specifications and Documentation, specifically excluding the Excluded Uses.

• Purchaser agrees not to, nor authorise any third party to use the Products as described in any Excluded Uses.

• Exceptions to the provisions of this Ordinance (except for Permitted Uses and Excluded Uses) may be approved as a Conditional District rezoning approval by the Board of Commissioners upon a recommendation by the Planning Board.

More Definitions of Excluded Uses

Excluded Uses means the use of any Product (a) in a stent or other Medical Device for which ARIAD has granted, or may hereafter grant, rights to a third Party or (b) as a Dimerizer for use in gene therapy, cell therapy or vaccines.

Excluded Uses means any and all use(s) of the Software that (a) is not in accordance with the Software’s Documentation or Specifications, (b) is the disassembling, reverse-engineering, reverse- compiling, or reverse-assembling of the Software, (c) is a modification, alteration, or creation of derivative works of the Software; (d) gains access to or determines the methods of operation of the Software; (e) use of Illumina’s Intellectual Property and Confidential Information to develop a product that is similar to the Software; (f) is a sublicense, resale, sublease, or other use of the Software for the benefit of any third party or to operate a service bureau for the benefit of a third party; (g) is a use of the Software on any processor or equipment not provided by Illumina; and/or (h) involves removal of any proprietary notice from any Software, Documentation, or Specifications;

Excluded Uses means the use of Virexxa in the Retained Territory for the treatment of all diseases included in Exhibit A (Indications for Excluded Uses).

Excluded Uses means any: (a) use of the Product to perform editing of a human embryo, (b) use of the Product as, or as a component of, an in vitro diagnostic device, (c) use of the Product to perform testing of human samples and specimens where results are reported, directly or indirectly, to a patient or healthcare practitioner, (d) use of the Product for purposes of manufacturing and/or providing for clinical use a human or veterinary product that require regulatory approval of the Product or of the human or veterinary product, or (e) use of the Product (or information generated from the use of the Product) that is either prohibited by applicable law or regulation, or contrary to ethical guidelines promulgated by established national and/or international ethical bodies (whether governmental or non- governmental).

Excluded Uses means (a) any illegal, unlawful or hazardous purpose; (b) a massage parlor; (c) the sale or display of objects or publications that are obscene or pornographic ("pornographic" shall mean any written or pictorial matter with prurient appeal or any objects or instruments that are primarily concerned with lewd or prurient sexual activity) or any other similar items commonly associated with peep show, massage parlor, or similar stores, but this clause "c" shall not be construed to prohibit mass-market magazines such as "Playboy" and "Penthouse"; and (d) the conduct of any obscene, nude, or semi-nude live or recorded performances or use for nude or semi-nude modeling, rap sessions, or as a so-called "rubber goods" shop, or as a sex club of any kind. (For purposes of the foregoing, "semi-nude" means less fully clothed, to any degree, than members of a typical audience in a typical courtroom.)

Excluded Uses means the use of the Process or Equipment in connection with any use other than food waste, municipal sludge or sewage water, or agricultural waste of agricultural manure.
