The Licensee shall be responsible for obtaining all relevant permits, licenses and/or approvals (including any Public Entertainment License and Screening Rights) from the relevant authorities including but not limited to the Ministry of Environment, Ministry of Information and the Arts and the Fire Safety Bureau which may be required to carry out any of the activities contemplated herein including without limitation, carrying out the Fitting Out Works and operating the Event.
If you delay taking possession of the Premises, we will not postpone the Fitting Out Works Rent-free Period (if any) and/or the Term.
Property Management Team shall have the right to, at its own discretion; stop the Fitting Out Works with immediate effect till the settlement of the discrepancy.
The Licensee shall submit all plans for the Fitting-Out Works for the Licensor’s approval prior to the commencement of such Fitting- Out Works.
Without prejudice to the aforesaid provision, the Property Management Team shall also be permitted to stop the work if the Fitting Out Works present any manner of threat to the safety or security of the Said Building.
The Tenant shall observe and comply with the “Design and Fitting-out Guide” and other relevant rules or requirements imposed by the Landlord or the manager of the Mall for the carrying out of the Fitting Out Works, if any, for and to the said premises.
If the Event Space is outside the Station, subject to the Licensee affixing the appropriate signages, protective coverings and cordoning off the Event Space (if necessary or required by the Licensor), the Licensee shall be permitted to carry out the Fitting Out Works during the day.
The occupation permit for the Hotel has been issued by the Building Authority and the Fitting Out Works are currently underway and are expected to be completed in or around March 2017.
The Tenant shall keep the Landlord and the Developer indemnified from and against any breach or non-performance of any conditions which may be imposed by any planning permission or building regulations relating to the Fitting Out Works and against any claim by an adjoining owner or occupier or member of the public or other person arising out of, or incidental to, the execution of the Fitting Out Works.
The Fitting Out Works shall not constitute or be deemed to be improvements in respect of which any claim for compensation shall at any time be made by the Tenant.
