Local state of emergency definition

Local state of emergency means a proclamation or declaration that activates the response and recovery aspects of any and all applicable local or interjurisdictional emergency operations plans and authorizes the furnishing of aid, assistance, and directives under those plans.

Local state of emergency means a City-declared “local state of emergency” as such term is defined in Chapter 52 of Part II of the Bay City Code of Ordinances, the “emergency management chapter”, as such chapter may be revised, except as follows: (i) the term shall not apply to City-declared states of emergency related to COVID-19 and other health-related pandemics; (ii) a City-declared state of emergency cannot be unique to, or target tolling or the UBP assets; (iii) a City-declared state of emergency cannot be longer than seven (7) days without approval of the City Commission following a public hearing; and (iv) the City Commission may extend a City-declared state of emergency for no more than fourteen (14) days at a time, subject to each extension requiring City Commission approval following a public hearing. For the avoidance of doubt, City must have a reasonable basis for declaring or continuing a local state of emergency, such basis must not be arbitrary or capricious and any City-declared state of emergency that impacts tolling or the UBP assets shall be rationally related to the need to suspend tolling or operation of the UBP assets. In all events, UBP shall not be obligated to cease tolling for a Local State of Emergency, unless the Local State of Emergency is generally applicable to all commercial activities within the City.
