Mutual NDA definition

Mutual NDA means the Micron-Inotera Mutual Nondisclosure Agreement entered into by Micron and the Company as of January 17, 2013, as amended.

Mutual NDA has the meaning set forth in Section 5.5.

• If this Agreement is terminated, the Mutual NDA shall remain in full force and effect, and all copies of documents containing confidential information of a disclosing party shall be returned by the receiving party to the disclosing party or be destroyed, as provided in the Mutual NDA.

• The Micron-NTC Mutual NDA is incorporated herein by reference, and the Parties agree that the Micron-NTC Mutual NDA shall govern the confidentiality and non-disclosure obligations of the Parties in connection with information exchanged under this Agreement.

Mutual NDA means that certain Confidentiality Agreement, dated as of April 20, 2004 by and between the Company and Placer.
