Class Settlement Fund definition

Class Settlement Fund means the fund that will be established and maintained to resolve the claims at issue, as described in Section III.A. below, and which is intended to be a qualified settlement fund within the meaning of Internal Revenue Code § 468B and Treasury Regulation § 1.468B-1.
Class Settlement Fund has the meaning described in Article III of the Class Settlement Agreement.
Class Settlement Fund means and refer to the total amount of settlement funds deposited in the Escrow Account pursuant to Section 10.1(a), together with all interest earned or accrued thereon, and less (a) the charges, expenses, etc., specified in the Escrow Agreement, and (b) the reserves, if any, established in furtherance of this Settlement Agreement.

More Definitions of Class Settlement Fund

Class Settlement Fund means the total settlement payment of up to Eight Million Twenty-Five Thousand Dollars ($8,025,000.00), to be paid by Bow for the benefit of the Settlement Class, to be funded pursuant to the schedule set forth in Paragraph 5 below, and to be used to pay all Claims of Eligible Claimants and Settlement Administration Costs that are approved by the Court.
