Notice of Final Action definition

Notice of Final Action shall specify the facts relied upon by the Superintendent’s designee in reaching his/her decision and shall refer to the policies, rules, laws or other legal basis on which the action is premised. The notice shall endeavor to place the employee on actual notice of the decision maker’s rationale.
Notice of Final Action shall also describe the employee’s right to have the decision reviewed through evidentiary hearing (see Section 5.04 below) or through the grievance procedure provided in Article III. The employee shall be provided a form on which s/he may indicate a binding election of one of these two review procedures or a decision not to request a review of the determination contained in the “Notice of Final Action.” The form shall include directions for filing within ten (10) days after receipt of the “Notice of Final Action.” The failure of an employee to file the form within this ten-day period is presumed to be a decision not to request a review of the determination contained in the “Notice of Final Action.”

Examples of Notice of Final Action in a sentence

  • If the recipient does give you a written Notice of Final Action on your complaint, but you are dissatisfied with the decision or resolution, you may file a complaint with CRC.

  • If you file your complaint with the recipient, you must wait either until the recipient issues a written Notice of Final Action, or until 90 days have passed (whichever is sooner), before filing with the Civil Rights Center (see address above).

  • You must file your CRC complaint within 30 days of the date on which you received the Notice of Final Action.

Related to Notice of Final Action

  • Notice of Motion means a notice setting out the text of a motion, which it is proposed to move at the next relevant meeting;

  • Notice of Dispute has the meaning provided in Section 2.1(f)(iii) of this Commercial Shared-Loss Agreement.

  • E-Statement means an electronic version of daily confirms, monthly, quarterly or annual statements, and shareholder tax statements created with investor transaction data housed on DST’s TA2000® mutual fund record keeping system, with images available online via a secure web site.

  • Objections Statement has the meaning set forth in Section 1.02(d).

  • Arbitration Notice has the meaning set forth in Section 9.13.

  • Statement of Grievance shall name the grievant(s) involved, the facts giving rise to the grievance, provision(s) of the Agreement alleged to be violated and the remedy (specific relief) requested.

  • Notice of Renewal has the meaning specified in Section 2.01(b).

  • Due notice means notice published at least twice, with an interval of at least six days between the two publication dates, in a newspaper or other publication of general circulation within the appropriate area; or, if no such publication of general circulation be available, by posting at a reasonable number of conspicuous places within the appropriate area, suchposting to include, where possible, posting at public places where it may be customary to post notices concerning county or municipal affairs generally. At any hearing held pursuant to such notice, at the time and place designated in such notice, adjournment may be made from time to time without the necessity of renewing such notice for such adjourned dates.

  • Notice of Action shall have the meaning set forth in Section 7.1C.
