The Michigan Employment Relations Commission having conducted a representation election on July 17, 1978, and having certified the Union as the exclusive bargaining agent, the University hereby recognizes the Union as the exclusive representative for all employees in the unit as described in Section 2.2 of this Article for the purpose of collective bargaining in respect to rates of pay, wages, hours of employment and other conditions of employment for the term of this Agreement.
Legal Basis. The Michigan Employment Relations Commission having conducted a representation election, and on January 14, 2014 having certified the Alliance as the exclusive bargaining agent, the University does hereby recognize the Alliance as the exclusive representative for all staff members in the unit as described in Section 2.2. of this Agreement for the purpose of collective bargaining in respect to rates of pay, wages, hours of employment and other conditions of employment for the term of this Agreement.
Legal Basis. Reduction in force shall be in accordance with Ohio Revised Code Section 3319.17, including financial reasons, declining enrollments and changing course offerings and selections. The Superintendent shall meet with the CHTU President at least thirty (30) calendar days before Board action to authorize a reduction in force. At this time the Superintendent shall provide a list of the potential positions to be eliminated and the names of the individuals who may be affected by the reduction.
Legal Basis. On December 1, 2008 the University recognized the Union, based on a unanimous confirmed expression of interest, as the exclusive representative for all employees in the unit as described in Section 2.2 of this Article for the purpose of collective bargaining in respect to rates of pay, wages, hours of employment and other conditions of employment for the term of this Agreement.
Legal Basis. If any provisions of this Agreement or any application of this Agreement to any employee or group of employees is held to be contrary to law, then such provision or application shall not be deemed valid and subsisting, except to the extent permitted by law, but all other provisions or applications shall continue in full force and effect.
Legal Basis. This balancing contract is concluded for the implementation of rights and obligations as regulated in accordance with the valid regulations, applicable in the Republic of Slovenia. The parties to the contract shall exercise their rights and obligations from this contract strictly in accordance with the provisions of the NC and in accordance with other regulations, applicable in the Republic of Slovenia. Furthermore, the parties also state that if any issue is not regulated with the contract or is regulated differently than stipulated by the current regulations in the field of natural gas, the provisions of the applicable regulations are used directly thereof. The parties expressly agree that the Transmission System Operator shall account for the services provided under this contract in accordance with the valid regulations in the Republic of Slovenia irrespective of the individual provisions of this contract. The Leader undertakes to immediately supply any changes of data or additional data to the Transmission System Operator, which would be required for correct billing of services according to this contract. Referencing the Energy Act (EZ-1), the NC or any other regulation under this contract also means referencing any changes of this regulation or act, replacing the aforementioned regulation or act or governing this field. In the event that any future changes of the aforementioned regulations are such as to require a change in the rights and obligations of contracting parties as set out in this contract, the parties undertake to supplement or change the contract accordingly. If individual provisions of this contract are in contravention of applicable regulations, this shall not affect the validity of the contract itself if the contract can remain in force without the void provision, whereby the law or other applicable regulation is used instead of the invalid provision.
Legal Basis. 3.1. This Deed is made pursuant to Section 106 of the Act and Section 111 of the Local Government Act 1972 and all powers so enabling.
3.2. The covenants, restrictions and requirements imposed upon the Owner under this Deed create planning obligations pursuant to Section 106 of the Act and are enforceable by the Council as local planning authority against the Owner.
Legal Basis. 5.1 Legal Grounds For the purposes identified in this Data Sharing Agreement the Parties confirm that the sharing and further processing of the defined personal data is based on the legal grounds set out in 5.1.1 and 5.1.2.
