Onerous Condition definition

Onerous Condition means any condition imposed by a Planning Permission or required in any Planning Obligation which falls within any of the sub-paragraphs of paragraph 4;
Onerous Condition means for these purposes, an action that requires a difficult or significant expenditure, in comparison to the size, resources and school budget; or changes in the structure of the institution not allowed by law or construction policies, in particular, those applicable to buildings of a historical heritage, as is the case of the school facilities. It is understood as any action or expense that may cause an overall negative impact on the institution. POLICY Antilles College of Health publishes the following policy on people with disabilities:  No person with a qualified disability will be denied the right to participate in any program, activity or work for said reason, nor denied benefits or be subject to discrimination due disability.  Antilles College of Health will provide reasonable accommodation, as previously defined, to give people with disabilities the same opportunity to achieve educational goals and have equal opportunities in the work environment.  Antilles College of Health ensures compliance of this policy against discrimination against people with disabilities, for these reasons, and publishes necessary procedures to request remedies, reasonable accommodations and complaint procedures.
Onerous Condition means any Council’s Onerous Condition and/or Developer’s Onerous Condition as the case may be;

Examples of Onerous Condition in a sentence

  • Each of the parties shall, and the Stockholders shall use their reasonable efforts to cause UGC and its Subsidiaries to, give each party prompt written notice of any proposal or action by any Governmental Entity or other Person to impose an Onerous Condition.

  • To Purchaser's knowledge, as of the date hereof, there is no reason why the regulatory approvals and consents referred to in this Section 5.2(c), Section 4.2(d) or Section 3.2(e) will not be received without the imposition of an Onerous Condition.

More Definitions of Onerous Condition

Onerous Condition means, in respect of an ORESS 1 Project, any of the following conditions contained in the Planning Consent for that ORESS 1 Project:
Onerous Condition means any action by a Governmental Entity or other Person that makes the consent, authorization, approval, permit, license or waiver of such Person to or of the consummation of the transactions contemplated by this Agreement contingent upon any party to this Agreement or any of their respective Affiliates (provided that for purposes hereof an Onerous Condition with respect to UGC or any of its Subsidiaries shall be deemed to be an Onerous Condition with respect to Liberty and not with respect to any Stockholder or any of its Affiliates) doing any of the following things:
Onerous Condition means a condition which is imposed either in a Planning Permission or reserved matters approval or other approval or contained in a Planning Agreement which the local planning authority and/or the Secretary of State requires to be entered into prior to the grant of such Planning Permission and which is either an Agency's Onerous Condition or Developer's Onerous Condition
Onerous Condition means (i) in the case of any condition on Buyer or its Affiliates (including, for these purposes, the Companies), a condition that would materially impair the ability of the Companies to conduct their business after the Initial Closing as conducted prior to the Initial Closing Date or (ii) in the case of any condition on the Sellers or their Affiliates (excluding the Companies), any condition that would materially impair the benefit to be derived by them from the transactions contemplated by this Agreement.
Onerous Condition means a condition imposed in a planning permission applied for under this Agreement or imposed or to be imposed in any planning agreement regulating the Development or use of the Property and which contains an obligation or restriction of any one or more of the following kinds:- 1.35.1 It requires the payment or expenditure of money or other consideration by way of planning gain or on works outside the Estate or 1.35.2 It prevents or unduly restricts the occupation of the Property for the Permitted Use or 1.35.3 It prevents the carrying out of the Development without the agreement or co-operation of an independent third party which cannot be obtained on a basis at a cost or within a time that in any such case is reasonably acceptable to the Landlord and the Tenant
Onerous Condition means a Waterfront Central Onerous Condition and/or a Waterfront East Onerous Condition (as applicable);
Onerous Condition has the meaning set forth in Section 6.7.
