All Operator Personnel must possess all relevant qualifications, licences and accreditations as required by law.
The Operator will indemnify and save harmless the City and City Personnel, from all claims and costs incurred by the City or City Personnel to the extent the same arise from a breach of this Agreement by, or the negligence of, the Operator or Operator Personnel or other persons for whom at law the Operator is responsible, as applicable.

The Harbour Operator shall ensure that adequate and appropriate equipment and facilities are available to enable first-aid to be rendered to Harbour Operator Personnel and third party users of the Harbour Facilities if they are injured or become ill at work, in compliance with the Health and Safety (First Aid) Regulations 1981, as amended from time to time.
For the avoidance of doubt, Operator shall not be excused from any indemnification obligations, claims for damages or Indemnifiable Losses suffered by Owner to the extent caused by Operator’s violation of Legal Requirements or Owner’s violation of Legal Requirements to the extent relating to, resulting from or arising out of or in connection with any act or omission by Operator, any Affiliate of Operator, or any Operator Personnel.
