Order to Restrain definition

Order to Restrain means the order issued to the Owner by an Officer, where the Officer is satisfied on the balance of probabilities and in the absence of any mitigating factor, that the dog has bitten a person and/or domestic animal, placed a person or domestic animal at risk of physical harm, or behaved in a manner that poses a menace to the safety of persons or domestic animals.
Order to Restrain means an order issued to the owner of a dog to adhere to certain restrictions with respect to the methods to be used in restraining his or her dog.
Order to Restrain means the order issued to the owner of a dog by the Animal Control Officer, where the officer is satisfied on the balance of probabilities and in the absence of any mitigating factor, that the dog has bitten a person or domestic animal.

Examples of Order to Restrain in a sentence

  • If an Owner fails to appear at such hearing, the Order to Restrain shall be deemed to be in full force and effect as if no appeal had been filed.

  • Any Owner to whom an Order to Restrain has been issued may inform Animal Services in writing that they intend to appeal the Order within seven (7) days of being served notice.

  • A request by the Owner for a hearing under this Section shall be made in writing and delivered to the Clerk within fifteen (15) days of the Owner receiving the Order to Restrain.

  • At the hearing, Council, or a committee of Council, has the power to amend, revoke or uphold the Order to Restrain.

  • Any Owner that fails to comply with the requirements of the Order to Restrain shall pay the set fine or permanently surrender the dog to Animal Services.

  • Where a final and binding Order to Restrain imposes conditions, the Owner shall provide proof of compliance to the conditions to the Canine Control Officer within thirty (30) days of the date of service of the Order to Restrain.

  • An Order to Restrain shall include a provision that any person served with an Order to Restrain has the right to appeal the Order to Restrain to Council, or a committee of Council, by filing a notice of appeal together with the reasons in support of the appeal in writing to the Clerk of the Township within ten (10) days of the date of service of the Order to Restrain.

  • The request shall be forwarded to the Animal Control Officer or the Peace Officer who shall investigate the request and shall uphold or deny the request to issue an Order to Restrain based on that investigation.

  • Animal Services shall maintain a record of all Orders to Restrain and shall notify the Municipality and local police authority of the issuance of the Order to Restrain and shall supply a copy of such Order to the Municipality and local police authority.

  • Concurrently, the Owner of the dog shall be served with a copy of the Canine Control By-law in effect at the time of the issuance of the Order to Restrain.

  • Transfer Restrictions means restrictions that prohibit the sale, exchange, transfer, assignment, pledge, hypothecation, fractionalization, hedge or other disposal (including through the use of any cash-settled instrument), whether voluntarily or involuntarily by the Grantee, of an Award or any shares of Common Stock, cash or other property delivered in respect of an Award.

  • Supine restraint means the restraint of a student in a face-up position on the student’s back on the floor or another surface and with physical pressure applied to the body of the student to keep the student in the supine position.

Minnesota Statute requires that the plan must, at least, list the restrictive procedures the school intends to use; describe how the school will monitor and review the use of restrictive procedures; and include a written description and documentation of the training school personnel completed.

  • Deed Restrictions means the deed restrictions to be recorded with respect to the Land, which deed restrictions shall be subject to the Director's approval and shall be commensurate with the nature and purpose of the Land as stated in the Recipient's application for grant funds under Revised Code Sections 164.20 through 164.27. The Deed Restrictions shall be perpetual and shall not be amended, released, extinguished or otherwise modified without the prior written approval of the Director, in the Director's sole discretion, who shall have full enforcement authority, as set forth more specifically in Section IX of this Agreement.

  • Transfer Restricted Definitive Notes means Definitive Notes that bear or are required to bear or are subject to the Restricted Notes Legend.

  • Restrictive Covenant Agreement means any agreement, and any attachments or schedules thereto, entered into by and between the Participant and the Partnership or its Affiliates, pursuant to which the Participant has agreed, among other things, to certain restrictions relating to non-competition (if applicable), non-solicitation and/or confidentiality, in order to protect the business of the Partnership and its Affiliates.

  • Order and Final Judgment means the order and final judgment of the Court approving the Settlement Agreement, as described in Section II(E)(7) below.
