Owner Delay definition

Owner Delay means, and is limited to, a Critical Delay to Contractor’s completion of the Work to the extent caused by one or more of the following: (i) Change Orders and Construction Change Directives (CCDs) (excluding minor changes in the Work and Design Professional interpretations), (ii) the Owner’s failure (or that of any other person for whom the Owner is responsible to the Contractor, including the Design Professional or a separate contractor hired by the Owner) to provide any data or information requested by the Contractor in writing that is reasonably necessary for Contractor to carry out its duties and is the Owner’s obligation to provide (so long as the Owner and any other responsible person are given adequate time to respond); or (iii) interference by the Owner or persons for whom it is responsible to the Contractor, including the Design Professional or a separate contractor hired by the Owner, with the Contractor’s performance of the Work (which continues after written notice to the Owner of such interference).

Owner Delay has the meaning provided in Section 4.4.1.

Owner Delay means any delay by Owner or GEC in performing obligations under this Agreement, which delay adversely affects Contractor’s cost, schedule or other performance under this Agreement.

Examples of Owner Delay in a sentence

• Buyer shall be entitled to the remedies provided under the TSA with regard to any such Transmission Delay, and Seller shall have no liability to Buyer for Delay Damages solely as a result of any Owner Delay or Concurrent Delay (each as defined in the TSA).

• In the event that there is both an Owner Delay and a Purchaser Delay and either Party wishes to extend any Distribution Company TSA Critical Milestone date by delivering additional Credit Support to Distribution Company, the additional Credit Support shall be provided in equal parts by Owner and Purchaser.

• Utility Owner Delay" shall mean a delay to a Critical Path that is directly attributable to a Utility Owner's failure to cooperate with DB Contractor in performing Utility Adjustment Work within the time period reasonably scheduled by DB Contractor for performance of such work, where DB Contractor and Utility Owner have not yet executed a Utility Agreement addressing such Utility Adjustment Work.

• Contractor shall use reasonable efforts to remove or mitigate the effects of any Force Majeure, Owner Delay, Governmental Authority or third party delay, varying or unforeseen Site condition, or Change in Law.

Owner Delay has the meaning provided in Section 4.4.1. “Owner Security” has the meaning provided in Section 16.1.

Owner Delay means any and all delays resulting from (i) Owner’s inability or failure to timely perform its obligations under this Agreement; (ii) any delays caused by the failure of any Contracted Third Party to timely perform its obligations under its agreement between Owner and such Contracted Third Party; and (iii) any delays caused by any Changes.

Owner Delay means any delay by Owner in achieving performance of its obligations under this Agreement, including any of the deadlines set forth in Section 7.1 of this Agreement with respect to the Project Improvements Work.
