Participating Collective Members definition

Participating Collective Members means Plaintiffs, Opt-In Plaintiffs, and all Settlement Collective Members who submit a valid and timely Claim Form or endorse a Settlement Payment check without altering the language included on the Claim Form or Check Opt-In Form (as detailed in Paragraph 22).
Participating Collective Members means all Putative Collective Members who timely cash and/or negotiate settlement checks within the deadline set forth in Paragraph 61.
Participating Collective Members means each Putative Collective Member who opts-in to the settlement by endorsing and cashing a Settlement Check within the Cashing Period.

More Definitions of Participating Collective Members

Participating Collective Members means (a) the Named Plaintiff; (b) Opt-In Plaintiffs; and (c) Notice Recipients who return a Qualifying Claim Form. Participating Collective Members shall be bound by the terms of this Agreement, including its release provisions.
Participating Collective Members means all Putative Collective Members who are not also California Class Members who timely submit valid Claim Forms before the Bar Date.
Participating Collective Members. Released Claim(s)” means any and all wage-and-hour, wage payment, and all wage-, pay-, or compensation-based causes of action, claims, rights, damages, punitive or statutory damages, interest, penalties, liabilities, expenses and losses and issues of any kind or nature whatsoever, whether known or unknown, against Prudential and Releasees concerning Participating Collective Members’ employment as exempt PLD IWs that were or could have been asserted in the Action based on the facts or claims alleged in the Complaint as of the date on which a Participating Collective Member signs his or her Qualifying Claim Form. These released claims specifically include, but are not limited to, all state and federal, statutory, regulatory, constitutional, contractual or common law claims for wages, unpaid wages, unpaid minimum wage, unpaid overtime wages, untimely paid wages, other claims relating to wage payment of any kind, failure to provide accurate wage statements or other notices required by law, wage deduction, any pay practices, and all related or derivative claims or other claims of any nature for wages or other compensation, and claims for any other form of compensation of any kind (including unjust enrichment or quantum meruit), including any and all claims for damages, unpaid costs or expenses, penalties, liquidated damages, punitive damages, interest, attorneys’ fees, litigation costs, restitution, or equitable relief, including, by way of example only, claims arising out of or based upon alleged violations of the FLSA, the New Jersey State Wage and Hour Law, the New Jersey Wage Payment Law, the New Jersey Wage Theft Act, the Connecticut Wage Payment Law, the Minnesota Fair Labor Standards Act, and Minnesota Wage Payment provisions (Minn. Stat. Ann. §§ 181.01 to 181.1721, as well as any similar, parallel, related or derivative laws. The released claims include, without limitation, claims meeting the above definition(s) under any and all similar or analogous state or federal laws, including but not limited to, the state laws of California, Colorado, Florida, Georgia, Illinois, Maryland, Missouri, North Carolina, Pennsylvania, and South Carolina, and are hereby released to the fullest extent permitted by law, regardless of forum.
Participating Collective Members means all Putative Collective Members who timely submit Claim Forms before the Bar Date.

Related to Participating Collective Members

  • Participating member means a member who is required to make mandatory contributions by the applicable retirement act to his or her health reimbursement account.

  • Class B Members means all such Persons.

  • Non-Participating Prosthetic Provider means a Prosthetic Provider who does not have a written agreement with the Claim Administrator or another Blue Cross and/or Blue Shield Plan to provide services to you at the time services are rendered.

  • Class A Members means those Members who have purchased Class A Interests.

  • Participating Companies means any insurance company (including Insurance Company) that offers variable annuity and/or variable life insurance contracts to the public and that has entered into an agreement with one or more of the Funds.

  • Participating Prosthetic Provider means a Prosthetic Provider who has a written agreement with the Claim Administrator or another Blue Cross and/or Blue Shield Plan to provide services to you at the time services are rendered.

  • Active military member means any person with full-time duty status in the armed forces of the United States, including members of the National Guard and Reserve.

  • Participant Group mean you, each of your holding companies and subsidiaries and each subsidiary of each of your holding companies.
