I have split out the Temporary Highway Works and the Permanent Highway Works so that they relate to the Residential and Employment Developments respectively.
I am instructed that Plot 3 of the Employment Development is to be excluded from the Permanent Highway Works and included in the Temporary Highway Works.
Permanent residence means a place where the person abides, lodges, or resides for 5 or more consecutive days.
Work/ works means work / works to be executed in accordance with the contract.
Extra Work means any work which is determined by City to be necessary for the proper completion of the Project, but which the Parties did not reasonably anticipate would be necessary at the execution of this Agreement. Consultant shall not perform, nor be compensated for, Extra Work without written authorization from City’s Representative.
Site Improvements means any construction work on, or improvement to, streets, roads, parking facilities, sidewalks, drainage structures and utilities.
The Works means the work or works to be executed or done under this contract.
