Phase I Completion Date definition

Phase I Completion Date means the date on which the Construction Supervisor issues a written notice (the "Phase I Completion Notice") to TEC certifying that the Phase I Performance Test has been completed.

Phase I Completion Date is hereby amended to read in its entirety as follows:

Phase I Completion Date shall have the meaning set forth in Section 9.2(a).

Examples of Phase I Completion Date in a sentence

• The term (the “Term”) of this Agreement shall commence on the Effective Date and shall end on the last day of the calendar month in which the 10th anniversary of the earlier of (a) the date that Phase I is completed, and (b) the Agreed Phase I Completion Date occurs (the “Initial Term”), subject to Section 2.3.

• The Design-Builder may request and/or the Owner, without invalidating this Agreement, may order changes in the Work within the general scope of the Contract Documents consisting of additions, deletions or other revisions to the GMP or the estimated cost of the work, compensation for Contract Services, the Design-Builder's Fee and/or the Phase I Completion Date being adjusted accordingly.

• The minute books and other similar records of the Company and the Subsidiaries to be provided to Buyer prior to the Phase I Completion Date have been and will be maintained in accordance with sound business practices and will contain a true and complete record of all action taken at all meetings and by all written consents in lieu of meetings of the stockholders, directors and committees of the boards of directors (or other similar governing entities) of the Company and the Subsidiaries.

More Definitions of Phase I Completion Date

Phase I Completion Date means June 30, 2017.

Phase I Completion Date means the date on which Bakex & X'Brien, Inc., as construction supervisor, issues a written notice (the "Phase I Completion Notice") to TARC certifying that (a) the process units and supporting facilities included in the definition of "Phase I" have reached mechanical completion, and (b) for a period of at least 15 consecutive days, the TARC Refinery has sustained (i) the successful performance of the Delayed Coking Unit, the Hydrodesulfurization Unit and the Sulfur Recovery System, (ii) an average feedstock throughput level of at least 150,000 barrels per day, and (iii)

Phase I Completion Date means the date on which the Construction Supervisor issues a written notice (the "Phase I Completion Notice") to the Borrower and the Disbursement Agent certifying that (a) the process units and supporting facilities included in the definition of "Phase I" have reached Mechanical Completion in accordance with the Plans, as defined in the Disbursement Agreement and (b) for a period of at least 15 consecutive days, the Refinery has sustained (i) the successful performance of the Delayed Coking Unit, the Hydrodesulfurization Unit and the Sulfur Recovery System, (ii) an average feedstock throughput level of at least 150,000 barrels per day, and (iii) no net production of vacuum tower bottoms when using as input a combined feedstock slate with an average API Gravity of 22 degrees or less.

Phase I Completion Date has the meaning ascribed to it in the forepart of this agreement.

Phase I Completion Date means the date on which the Disbursement Agent countersigns the Company's Completion Certificate for the Phase I Project (including the Entertainment Facility and the Fairway Villas) pursuant to Section 2.7 of the Disbursement Agreement acknowledging that Completion of the Phase I Project has occurred.
