Phase I Completion Date definition

Phase I Completion Date means the date on which the Construction Supervisor issues a written notice (the "Phase I Completion Notice") to TEC certifying that the Phase I Performance Test has been completed.

Phase I Completion Date is hereby amended to read in its entirety as follows:

Examples of Phase I Completion Date in a sentence

• The term (the “Term”) of this Agreement shall commence on the Effective Date and shall end on the last day of the calendar month in which the 10th anniversary of the earlier of (a) the date that Phase I is completed, and (b) the Agreed Phase I Completion Date occurs (the “Initial Term”), subject to Section 2.3.

• The Phase I Completion Date shall be confirmed by the County upon the TAC's Project architect delivering certificates to the Parks Director stating that construction on Phase I has been substantially completed, and the TAC completing a final punch list of tasks as required by the County.

• Upon completion of the improvements to the Additional Parking Area and issuance by the City of a Certificate of Completion for the second part of the Phase I Development, the Phase I Development shall be complete in its entirety and the Phase I Completion Date shall have occurred, as required by the Lease and the DDA.

More Definitions of Phase I Completion Date

Phase I Completion Date means the date, determined by Lender, Borrowers shall have delivered to Lender, in each case in form and substance satisfactory to Lender, the following:

Phase I Completion Date means the date on which the Construction Supervisor issues a written notice (the "Phase I Completion Notice") to the Borrower and the Disbursement Agent certifying that (a) the process units and supporting facilities included in the definition of "Phase I" have reached Mechanical Completion in accordance with the Plans, as defined in the Disbursement Agreement and (b) for a period of at least 15 consecutive days, the Refinery has sustained (i) the successful performance of the Delayed Coking Unit, the Hydrodesulfurization Unit and the Sulfur Recovery System, (ii) an average feedstock throughput level of at least 150,000 barrels per day, and (iii) no net production of vacuum tower bottoms when using as input a combined feedstock slate with an average API Gravity of 22 degrees or less.

Phase I Completion Date means the date on which Bakex & X'Brien, Inc., as construction supervisor, issues a written notice (the "Phase I Completion Notice") to TARC certifying that (a) the process units and supporting facilities included in the definition of "Phase I" have reached mechanical completion, and (b) for a period of at least 15 consecutive days, the TARC Refinery has sustained (i) the successful performance of the Delayed Coking Unit, the Hydrodesulfurization Unit and the Sulfur Recovery System, (ii) an average feedstock throughput level of at least 150,000 barrels per day, and (iii)

Phase I Completion Date means June 30, 2017.

Phase I Completion Date means the date on which the Disbursement Agent countersigns the Company's Completion Certificate for the Phase I Project (including the Entertainment Facility and the Fairway Villas) pursuant to Section 2.7 of the Disbursement Agreement acknowledging that Completion of the Phase I Project has occurred.

Phase I Completion Date has the meaning ascribed to it in the Cooperation Agreement.

Phase I Completion Date means the date on which Ex-Im Bank has determined that Phase I Completion is achieved.
