Recalled Product definition

Recalled Product means any Product subject to a Recall.
Recalled Product means Product which Supplier or a governmental authority for any reason determines: (i) may violate Applicable Law; or (ii) the use or consumption of which may pose an undue risk to public health or safety

  • Horizon shall not dispose of any damaged, nonconforming or Recalled Product as to which it intends to assert a claim against sanofi-aventis without sanofi-aventis’ written authorization to do so.

  • JULPHAR’s sole obligations, and DANCE’s sole and exclusive remedies, for any breach by JULPHAR of this Agreement related to nonconforming Active Ingredient or Recalled Product shall be as set forth in Sections 11.1 and 11.2 hereof, respectively.

  • In the event that any Recall with respect to a Product is the direct result of a breach of any warranty of Exelixis set forth in Section 8.2 and is not the result of Licensee’s, its Affiliates’, or its sublicensees’ transportation, storage, marketing, use, sale, or distribution of the Product, then Exelixis shall bear (and reimburse Licensee for) all of the costs and expenses of such Recall and the destruction of such Recalled Product.


More Definitions of Recalled Product

Recalled Product shall have the meaning set forth in Section 13.3.
Recalled Product means any product where the manufacturer of the product makes or has made a request to return the product for reasons including the discovery of safety issues or product defects.
