• The Supplier agrees to co-operate and liaise, at its own expense with Requesting Bodies to arrange for the application of the Ancillary Terms and Support Rates to the Vehicle Contracts and the Supplier shall take such steps as may be reasonably required by Requesting Bodies to enable the Requesting Body to receive the benefit of this Framework Schedule 21 (Requesting Bodies and Ancillary Terms).

• The Supplier will in writing, by the time and date specified by the Requesting Body in accordance with Paragraph 3.2.2(b) provide the Requesting Body with either: a statement to the effect that it does not wish to tender in relation to the relevant requirements; or the Ancillary Terms and Support Rates and full details of its tender made in respect of the relevant requirements.

• The Supplier agrees that all tenders submitted by the Supplier in relation to a further competition held pursuant to this Paragraph 3 shall remain open for acceptance by the Requesting Body for ninety (90) days (or such other period specified in the invitation to tender issued by the relevant Requesting Body).

• The Supplier acknowledges and agrees that no vehicles will be supplied pursuant to this Framework Schedule 21 (Requesting Bodies and Ancillary Terms) as vehicles will (if so requested by a Requesting Body) be provided pursuant to other contractual arrangements between the Requesting Body and the Supplier.

• Nothing in this Framework Agreement shall oblige any Requesting Body to purchase any vehicles or associated services.

• Notwithstanding the fact that the Requesting Body has followed a procedure as set out above, the Requesting Body shall be entitled at all times to decline to make an award for its requirements.

• If a Requesting Body considers that enhanced Ancillary Terms and Framework Support Rates can be achieved through a further competition between Framework Suppliers then, subject to the written approval of the relevant Contracting Body, the Requesting Body shall be entitled to conduct a further competition in accordance with this Paragraph 3.

• For the avoidance of doubt, this paragraph does not apply: where the Contracting Body is receiving a vehicle via a Requesting Body in accordance with Schedule 21; or to Support Rates specified in a Call Off Agreement that are higher than the Framework Support Rates.

• Where a Requesting Body requires the application of the Ancillary Terms and Support Rates into a Vehicle Contract then notwithstanding any provision to the contrary in the Vehicle Contract, the Supplier agrees that the Ancillary Terms and Support Rates shall apply to such Vehicle Contract and shall be incorporated automatically into such Vehicle Contract.

• The Requesting Body, in placing a Vehicle Contract which includes Ancillary Terms and Support Rates, shall enter into a Vehicle Contract which includes the Ancillary Terms and Support Rates with the Supplier for the provision of vehicles and associated services referred to in that Vehicle Contract.
