Restricted Capacity definition

Restricted Capacity means the provision of services to a competitor of the Company which is the same or comparable to the services the Executive provided to the Company or any of its Company Affiliates or in which the Confidential Information, trade secrets or customer goodwill which the Executive created or to which the Executive had access during the Executive’s employment with the Company or any of its Company Affiliates would give that competitor an unfair competitive advantage.
Restricted Capacity means any capacity during your employment, or with respect to the portion of the Non-Compete Period that follows from the termination of your employment, any capacity that is the same or similar to the capacity in which you were employed by your Employer, the Company or any of its Subsidiaries at any time within the twelve (12) month period immediately preceding such termination and/or involves any services that you have provided to your Employer, the Company or any of its Subsidiaries at any time within such twelve (12) month period.
Restricted Capacity means a position which is the same or comparable to the position the Executive held with the Company or in which the Confidential Information or customer goodwill which the Executive created or to which the Executive had access during the Executive’s employment with the Company would give that competitor an unfair competitive advantage. For the avoidance of doubt, this definition as used herein shall in no way diminish the Executive’s obligations under Section 7.

Examples of Restricted Capacity in a sentence

  • Once the maximum capacity, as determined by the Promoter, at any Restricted Capacity Area has been reached, the Promoter or Event Staff may prevent further admissions to the Restricted Capacity Areas.

  • Throughout any period during which Executive is an employee of the Employer, and for a period of eighteen (18) months from and after the date upon which Executive shall cease for any reason whatsoever to be an employee of the Employer, Executive covenants and agrees that Executive will not engage, in any Restricted Capacity, in any business that is in Competition with the Employer within the Restricted Area.

  • If a Restricted Capacity Day has an impact on any NDM Supply Point the Transporter may declare an Emergency according to the provisions of Section 1 (Emergencies).

  • If you attempt to enter or enter a Restricted Capacity Area where you are not permitted to do so, you may be evicted from the Event.

  • You acknowledge that the Promoter may set restrictions on the number of people that can attend certain areas of the Event Site, such as within buildings or structures, within enclosed areas or at stages (Restricted Capacity Areas).


More Definitions of Restricted Capacity

Restricted Capacity means any match played where regulations in place do not allow a full stadium capacity.

Restricted Capacity means the capacity of a principal, partner, joint venture, director, officer, manager, employee, contractor, consultant, adviser, agent, trustee, beneficiary, unit-holder or shareholder (other than a holder for the purpose of investment only of no more than 5% of the issue capital of any company or trust whose shares or unit s are listed on a recognized stock exchange) PROVIDED THAT in such capacity you may directly or indirectly benefit from using or disclosing Confidential Information or interfering with a Customer, Supplier or Restricted Person or you are capable of causing damage to the business of the Company or the Company Group.
Restricted Capacity means the involvement of the Executive in a capacity that, whether directly or indirectly, individually or in partnership or otherwise jointly or in concert with any other Person: (i) provides advice to or has a financial interest in any Person in a business that is the same as the Business of the Company; or (ii) lends money to, provides ​ financial assistance to or guarantees the debts or obligations of any Person for the purpose of conducting a business that is the same as the Business of the Company;
Restricted Capacity means a capacity in which the Executive performs or would perform services and/or discharge duties which are the same or similar to any duties and/or services provided by the Executive to the Group during his employment with the Company.
Restricted Capacity means any capacity, or with respect to the portion of the Non-Compete Period that follows termination of your employment, any capacity that is the same or similar to the capacity in which you were employed by your Employer, the Company or any of its Subsidiaries at any time within the two (2) year period immediately preceding such termination and/or involves any services that you provided to your Employer, the Company or any of its Subsidiaries at any time within such two (2) year period. (h) “Specified Job Families” are those job families which State Street has identified as having access to confidential and proprietary information, trade secrets, or goodwill that require protection following termination of employment for any reason.
