This Lease is and shall be construed as a “triple net lease” and Tenant shall pay or cause to be paid all expenses to maintain the Premises (other than public Roadways and Utilities for which the City or utility companies are responsible) throughout the Term, except as otherwise provided herein.
Roadways shall be designed in accordance with design data and criteria of the Ministry of Transportation as revised from time to time.
Roadways shall be constructed in the locations and to the widths and grades indicated within Schedules "A-1" and "E" and set out in Schedule "D" attached hereto.
Except as otherwise specifically provided in this Lease relating to remedies for a Tenant Default (defined herein) under this Lease, during the Term of this Lease, Tenant shall have the exclusive right to the possession and (together with its invitees, successors and assigns) use of the Premises (other than public Roadways and Utilities for which the City or utility companies are responsible).
Roadways shall not be used at a speed in excess of ten (10) miles per hour and shall not be used for parking or stopping, except for the immediate loading and unloading of passengers.
